Amalga Planning and Zoning Minutes September 2, 2026 7:00 PM 6590 N 2400 W Amalga, Utah 1. Roll Call Commission Members: Nate Noyes, Chair. April Hansen, Aaron Wood, LeAnn Campbell, Kelly Noble. Rayslyn Larsen, Town Board. Visitors: Ed Dursteler, Charlie Erickson, Roxnne Freestone, Brian Larsen, Tammy Munk, Mike Morley, Mike Bouck, April Turner, Diana Broadbent, Sid Munk, 2. Rayslyn Larsen, Town Board New IT person needed, would need to be approved by Town Board Diana Broadbent is interested in the P&Z secretary position. That could be decided and voted on by the P&Z Commission. Diana suggested help with the Website. Possibly a Bridgerland intern. IT position would have to be approved by Town Board. Motion to Approve Diana Broadbent of Secretary for Planning and Zoning-Kelly Noble Second-Nate Noyes Motion Carried Appeal was dismissed. There was a problem with the Fuel Station ordinance was handled. This is going to require that P&Z start from the beginning to handle the request for a Fuel Station. It was suggested that a work shop would in the long run save time and effort. 3. Minutes of August 11, 2026 Motion to Approve-Nate Noyes Second-Kelly Noble Motion Carried 4. Brian Larsen wanted to discuss maintenance on the northern drainage ditch. Feels that the culvert that runs under the road is not big enough to handle large amounts of water. If road work in that area is required it would be a good idea to replace it with a larger culvert. This is not a Planning and Zoning issue, however, Brian was told to start with P&Z. He will take this issue to the Town Board as well. He brought up Section 3.30 of the Land Use Management Code, Amalga Northern Drainage Ordinance. There is no clear point of who is in charge of this. He will take this to the Town Board. 5. Zoning Clearance Application from Roxanne Freestone to move a manufacture home from Parcel Number 13-001-0028 to Parcel Number 13-014-0023, the northern most of the 3 Noble lots. County has approved the move of this home. Perc test has been approved, gas hookup is available, as is electricity. Set backs were approved. It has been looked at by a moving company, and can be moved. Motion to Approve-LeAnn Campbell Second-Kelly Noble Motion Approved 6. Discussion with Tammy Munk about drainage around the proposed site of the Fuel Station. Tammy explained the importance of the drains in that area. She presented a letter that explains her position. That letter follow ''I want to explain why our family is concerned about the proposed gas station and why we believe this location deserves careful consideration before the project moves forward. The proposal includes large gasoline and diesel storage tanks along the edge of our property, directly next to our farmland and an existing drainage system. Our property borders the 9 acres on two sides. That 9 acres has field drains and land drains that carry agricultural drainage water away from our farmland. Those drains are on all three sides of the 9 acres. The water comes into the drains on the east side they wrap around to the west side. There is a well the west side towards the road. The water is then pumped back towards the south west it then goes into a wet land area. That water is pumped from the wet land into lines that serve the Gladfelder Ranch and Lindley Farms irrigation systems. Because this is part of an agricultural drainage system serving multiple farms, it is important that the drainage continues to function properly and is protected from damage or contamination. My husband has spoken with Charlie Erickson about the drainage issue. Approximately four feet of dirt has been added next to the drain area, and we are already seeing erosion as water runs off and washes the soil into the drain. That 9 acres needs to have a large berm for containment so that oil, gas and diesel spills can be contained and not go into that drainage system. Our concern is what will happen if construction continues and these large fuel tanks are placed next to the drainage system. We understand that modern fuel tanks have safeguards. However, petroleum leaks and spills still occur, which is why Utah has regulations and a cleanup program specifically for leaking petroleum storage tanks. In 2020, the Utah Department of Environmental Quality reported 123 cases of fuel spills or leaks statewide. Notably, in March 2025, a delivery error at a gas station in Hyrum resulted in over 1,300 gallons of fuel spilling into the environment. Our concern is that the location of the tanks would sit directly beside this agricultural drainage system. If there was a fuel leak or contaminated runoff, we want to know what protections would prevent that contamination from entering the drainage system and potentially affecting the Gladfelder ranch and Lindley farms and our agricultural property. For years our farm has rented that 9 acre land from the Erickson's to put manure on in the summer and then in the fall we haul it out, when we have fields to put the manure on. Our guys have spent a lot of time and effort protecting those drains over the years and keeping them clean. They have been in there at least 65 years. Before this project should be approved, we believe there needs to be clear answers about: - How the large fuel tanks will be contained and protected from leaks and spills. - - How stormwater and drainage will be managed. - - How our existing field drains will be protected during and after construction. - - What will prevent contaminated runoff from entering the agricultural drainage system. - - What will be done to stop the 4 feet of dirt from continuing to erode into the drain. - - Who will be responsible if the project damages the drainage system or affects neighboring agricultural properties. - - How will they protect the underground water from being contaminated? We are not opposed to responsible development. We are asking the Town to make sure this particular project is appropriate for this particular location and that the potential impacts to the surrounding agricultural land and drainage system are fully addressed. This is about protecting our farmland, our drainage system, and the agricultural operations that depend on it.'' Nate Noyes is concerned that any regulation the town proceeds with could be applied to all the rest of fuel storage in the town. Munks maintain that they have maintained the drains in the past. 7. Discussion with Jeff Broadbent. As the town is planning to re-do the ordinances pertaining to Fuel Station/convenience Store, Jeff would like P&Z to look especially at 7.1 which specifically mentions explosive materials not being allowed in this zone. The code needs to be looked at in regards to this particular issue. The ordinance that came out was not aligned with the terminology that was used to describe the project. Utah Planning and Zoning does differentiate between gas stations and truck stops. Asking, if we want to go forward with this, what is it that the people in Amalga really want? Believes it is important that the community accepts what is going to be built there and have an ordinance that aligns with that. Nate would like to create a subcommittee to figure out what the town wants. 8. Nate would like to revisit the secondary housing proposal. Suggests that it is brought from Planning and Zoning. Aaron agrees it needs to be looked at again. Nate would like a moratorium on major subdivisions outside of what is able to be developed along current accessible lots. Rayslyn will approach Town Board about a moratorium on major subdivisions. Motion to recommend to the Town Board that an 18 month moratorium on major subdivisions-Kelly Noble Second-Nate Noyes Motion Carried Discussion about the scales at Sid Munks. Sid says he has obtained legal council and that they said that P&Z recommended that they put it on blocks off the ground and it didn't need a building permit. Blocks will be level with the ground. Pins will be removable. Says that scale is removable. April read that Seth Tait said it would ultimately be up to P&Z if it is a structure or not. Sid maintains that the scale is removable. April brought up safety concerns of trucks pulling on and off. Nate advised that signs be place while scale is in use to alert public. Sid thanked board for suggesting signs.
