ORDINANCE NO. O-40-2026 AN ORDINANCE OF EAGLE MOUNTAIN CITY, UTAH, AMENDING THE EAGLE MOUNTAIN MUNICIPAL CODE CHAPTER 3.30 REGARDING LAND DISPOSALS PREAMBLE WHEREAS, Eagle Mountain City, Utah, is a municipal corporation organized and existing under the laws of the State of Utah; and WHEREAS, during the 2026 Legislative Session, the Utah Legislature enacted House Bill 535, concerning the disposition of certain publicly owned property and modifying the statutory procedure applicable to the disposal of public property, and WHEREAS, House Bill 535 changes when a public hearing is required in connection with the disposal of publicly owned real property and establishes additional notice requirements that must be satisfied before certain land disposals may occur; and WHEREAS the City Council desires to amend the Eagle Mountain Municipal Code so that the City's procedures for the disposal of significant City-owned real property conform to applicable Utah law while maintaining an orderly, transparent, and publicly accountable process; and WHEREAS, the City Council of Eagle Mountain City finds that the amendments adopted by this Ordinance are necessary and appropriate to ensure that City procedures remain consistent with state law and provide appropriate notice and opportunities for public participation when required. NOW THEREFORE, BE IT ORDAINED by the City Council of Eagle Mountain City, Utah: 1. The City Council finds that all requirements have been completed for the City Council to consider an amendment to the Eagle Mountain Municipal Code Chapter 3.30 regarding Land Disposals, as described in Exhibit A. 2. The amendment described in Exhibit A is hereby approved. 3. The City Council has considered the impact of this Ordinance on and found it consistent with family, health, stability, and formation as required by Utah law. 4. This Ordinance shall become effective immediately upon its passing. ADOPTED by the City Council of Eagle Mountain City, Utah, this 1st day of September, 2026.
