Public notice is hereby given that the City Council of the City of St. George, Washington County, Utah, will hold a regular meeting in the City Council Chambers at the St. George City Hall located at 61 South Main Street, St. George, Utah, on Thursday, August 20, 2026, commencing at 5:00 p.m.

a. Consider approval to award bid to Layton Construction Company LLC for the Minimum Equipment List (MEL) for the Air Traffic Control Tower.
BACKGROUND and RECOMMENDATION: This item is to purchase the minimum equipment list for the new air traffic control tower. The air traffic control tower is 80% complete. The minimum equipment list (MEL) is the next phase in order to receive FAA approval for operational readiness. The ATCT minimum equipment list includes essential communications, surveillance, weather, recording, power, and operational-support equipment required to maintain safe and effective air traffic control tower operations. Bids were requested and one bid was received back. The bid was from Layton Construction in the amount of $2,614,309. Staff recommends approval.
b. Consider approval of purchasing new playground surfacing tiles from PlaySpace Designs for the Vernon Worthen Park playground.
BACKGROUND and RECOMMENDATION: This item is for the replacement of the playground surface tiles for Vernon Worthen Park. The current tiles have begun to lift and deteriorate and are in need of replacement. This purchase is for the material cost of the project. It is anticipated that the Parks Division will install the tiles. Staff received a quote from PlaySpace Designs through a state contract for this purchase in the amount of $165,476.80. Vernon Worthen Park Playground Tile Replacement is included in the FY 2027 Business Plan. Staff recommends approval.
c. Consider approval of purchasing playground equipment through a Sourcewell Cooperative Contract with Landscape Structures, Inc. for Thunder Junction Park Phase 2.
BACKGROUND and RECOMMENDATION: This proposed purchase is to provide new playground equipment for Thunder Junction Park Phase 2 and is for materials and delivery only. Playground surfacing and installation will be done by others. The proposed playground equipment includes swings, sensory panels, musical play, spinners, and a shade sail structure. Staff received a quote from Landscape Structures, Inc. through a Sourcewell Cooperative Contract for this purchase in the amount of $139,995.56. The Thunder Junction Park Phase 2 project is included in the FY 2027 Business Plan and is a 2023 Trails, Parks and Recreation G.O. Bond project. Staff recommends approval.
d. Consider approval of purchasing playground equipment via a NPPGov Cooperative Procurement Contract with Berliner Seilfabrik Play Equipment Corporation for Thunder Junction Park Phase 2.
BACKGROUND and RECOMMENDATION: This proposed purchase is to provide new playground equipment for Thunder Junction Park Phase 2 and is for materials and delivery only. Playground surfacing and installation will be done by others. The proposed playground equipment includes two slides and nine inground trampolines. Staff received a quote from Berliner Seilfabrik Play Equipment Corporation via a NPPGov Cooperative Procurement Contract for this purchase in the amount of $164,523.36. The Thunder Junction Park Phase 2 project is included in the FY 2027 Business Plan and is a 2023 Trails, Parks and Recreation G.O. Bond project. Staff recommends approval.
e. Consider approval of purchasing playground equipment through a state contract with PlaySpace Designs for Thunder Junction Park Phase 2.
BACKGROUND and RECOMMENDATION: This proposed purchase is to provide new playground equipment for Thunder Junction Park Phase 2 and is for materials and delivery only. Playground surfacing and installation will be done by others. The proposed playground equipment includes a mammoth, giant sloth, cliff rider, climbers, spinner, communication panel, and robinia poles. Staff received a quote from PlaySpace Designs through a state contract for this purchase in the amount of $687,044.06. The Thunder Junction Park Phase 2 project is included in the FY 2027 Business Plan and is a 2023 Trails, Parks and Recreation G.O. Bond project. Staff recommends approval.
f. Consider approval of a contract with Suncore Construction and Materials, Inc. to construct the 250 West Reconstruction project (Black Ridge Dr. to Tech Ridge Pkwy).
BACKGROUND and RECOMMENDATION: This item is to consider award of a construction contract for the reconstruction of Black Ridge Dr. to Tech Ridge Parkway. The 250 West Reconstruction is approximately 700 feet long, the project includes a full road over-excavation, storm drain and water utilities, pavement, curb and gutter and sidewalk. The City requested bids and six bids were received back. Based on the evaluation of the bids received the highest scoring bid was from Suncore Construction and Materials, Inc. in the amount of $854,000. Staff recommends approval.
g. Consider approval of a contract with JP Excavating, Inc. to construct the George Washington Boulevard from the Virgin River Bridge to River Road project.
BACKGROUND and RECOMMENDATION: The George Washington Boulevard Construction - Virgin River Bridge to River Road project includes connecting George Washington Boulevard from the new Virgin River bridge to River Road. It also incorporates utilities, drainage, a pedestrian overpass and related work. A total of 9 bids were received for the project. The bids were evaluated based on four categories; Work Qualification, Past Performance, Construction Schedule, and Bid Cost. JP Excavating, Inc. is the highest scoring bidder and is recommended for project construction.
h. Consider approval of the Kern River Gas Transmission Agreement.
BACKGROUND and RECOMMENDATION: This agreement will extend our existing Kern River Gas capacity contract for an additional ten years beyond its current end date of 2033. Staff recommends approval.
i. Consider approval of a professional services agreement for construction engineering with Rosenberg Associates for the George Washington Boulevard Virgin River Bridge to River Road project.
BACKGROUND and RECOMMENDATION: This item is a professional services agreement with Rosenberg Associates for the construction engineering of the George Washington Boulevard Construction - Virgin River Bridge to River Road in the amount of $264,010. This agreement provides comprehensive construction engineering services for the City of St. George, including coordination with city departments, utilities, contractor, and environmental compliance.
j. Consider approval of a Professional Services Agreement with Fehr & Peers for the Suntran Transit System Study.
BACKGROUND and RECOMMENDATION: This item is for the award of a professional service agreement for the Suntran Transit System Study. On May 8, the City issued a Request for Proposals (RFP) for a comprehensive Transit Study. In response, 12 proposals were received. Following an initial review, the top three highest scoring firms were selected to advance to the interview stage. Panel interviews were conducted on July 31. Based on the evaluation of the proposal and interview, Fehr & Peers was identified as the highest scoring proposal. This is an item included in the FY 2026 Business Plan. Staff recommends approval.
k. Consider approval of a lease agreement with the St. George Area Chamber of Commerce for property located at 136 North 100 East.
BACKGROUND and RECOMMENDATION: The previous 10-year lease between the City of St. George and the St. George Area Chamber of Commerce for use of the City-owned property at 136 North 100 East expired in June 2026. The proposed agreement provides for the Chamber's continued use of the property under a new five-year lease. Under the proposed lease, the Chamber will be responsible for all interior and exterior maintenance of the property throughout the lease term. The lease provides for two automatic five-year renewal periods unless either party provides written notice of non-renewal prior to the end of the applicable term. The annual rent remains nominal at $1 per year. Staff recommends approval.
l. Consider a fee waiver for the inaugural Hope in Every Step 5K/1K Race during Stomach Cancer Awareness Month in November.
BACKGROUND and RECOMMENDATION: This is the first time Kendle Salisbury is applying for a Special Events Permit as well as submitting a fee waiver request for this inaugural event. Kendle has been battling cancer and would like to give back to raise funds for the Hope for Stomach Cancer. Hope for Stomach Cancer has resources available such as oncologists, nutritionists, and a community of others who are also fighting stomach cancer.
m. Consider approval of the minutes from the meetings held on August 6, 2026 (work meeting); and August 6, 2026 (regular meeting).
3. Public hearing and consideration of Ordinance No. 2026-063 annexing property into the City of St. George, and adjusting the corporate boundary lines, to include 2.277 acres located at the intersection of 3430 East in St. George and 3930 South in Washington City.
BACKGROUND and RECOMMENDATION: At their meeting held on May 28, 2026, the City Council approved a resolution to accept the Petition for Annexation for approximately 2.277 acres located at the intersection of 3430 East in St. George and 3930 South in Washington City, and is identified as Tax ID No. 6615-A. Following the approval of the resolution, the City must certify the Petition and mail written notices. Following the certification, the City Recorder posts a public notice giving residents notice that an annexation petition has been filed and that the City may grant the petition and annex the area unless a written protest to the annexation is filed with the Washington County Boundary Commission; the City has not received notice of any protests.
4. Public hearing and consideration of Ordinance No. 2026-064 to vacate a portion of the Sage Haven Phase 15 Subdivision plat identified as a temporary turnaround easement, located at the west end of Somera Drive.
BACKGROUND and RECOMMENDATION: The Sage Haven Phase 15 Subdivision plat identifies a temporary turnaround easement located within the overall boundary of the subdivision, whereas temporary turnaround easements are typically established outside the subdivision boundary. The vacation of this easement is being requested to allow Sage Haven Phase 20, which is being recorded concurrently, to proceed to the recording stage. Upon recording of Sage Haven Phase 20 Subdivision, Somera Drive will continue to provide access to and service the lots in the area without interruption. The Joint Utilities Commission recommended approval.
5. Public hearing and consideration of Ordinance No. 2026-065 vacating a portion of a municipal utility easement located between Lot 122, Cecita Crest at Divario Phase 3 and Lot 123, Cecita Crest at Divario Phase 3 Partial Amendment A.
BACKGROUND and RECOMMENDATION: The subdivision plat identifies a 7.50-foot-wide easement on each side of Lot 122, Cecita Crest at Divario Phase 3 and Lot 123, Cecita Crest at Divario Phase 3 Partial Amendment A. By vacating this easement the owner can merge these two lots together into one lot. The Joint Utilities Commission recommended approval.
6. Consider approval of a Conditional Use Permit for a private school serving students through grade eight (8) located in a designated landmark site in a residential zone on approximately 0.21 acres located at 135 South 100 East. (Case No. 2026-CUP-003 - Bare Foot Montessori)
BACKGROUND and RECOMMENDATION: The proposal is a conditional use permit to operate a private school serving students through grade eight (8) with a maximum of thirty (30) students. At their meeting held on August 11, 2026, the Planning Commission recommended approval unanimously in a vote of 7-0 based on the findings listed in the staff report and with the following conditions: 1. A maximum of 30 students shall be allowed; 2. If additional teaching stations are added a new site plan showing additional parking spaces will be submitted to the Community Development Department; and 3. Any event open to the public must obtain a special event permit.
7. Consider approval of Ordinance No. 2026-066 amending the City Zoning Map by changing the zone from RE-20 (Residential Estates, 20,000 ft² minimum lot size) to RE-37.5 (Residential Estates, 37,500 ft² minimum lot size) on approximately 6.20 acres generally located west of the St. George/Washington border and approximately 2450 South. (Case No. 2026-ZC-001 - RL Wyman 2450 South)
BACKGROUND and RECOMMENDATION: The underlying general plan is AE (Agricultural Estates) with adjacent zoning of RE-20 (Residential Estates, 20,000 ft² minimum lot size), R-1-10 (Residential 10,000 ft² minimum lot size) & A-1 (Agricultural, 40,000 ft² minimum lot size), A-1 (Agricultural, 40,000 ft² minimum lot size) & (Washington City - R-1-10 - Residential 10,000 ft² minimum lot size), and RE-37.5 (Residential Estates, 37,500 ft² minimum lot size). At their meeting held on February 24, 2026, the Planning Commission held a public hearing, and recommended approval with no conditions, with a vote of 6-0; there were no public comments.
8. Consider approval of Ordinance No. 2026-067 amending the Atkinville Interchange Zone Planned Development Commercial zone on approximately 3.4 acres generally located east of Arrowhead Canyon Drive and south of Havasu Drive. (Case No. 2026-PDA-009 - Buck's Ace Sun River)
BACKGROUND and RECOMMENDATION: The proposal is for a new 45,686 sq. ft. hardware and retail store. The underlying general plan is PD (Planned Development). At their meeting held on July 28, 2026, the Planning Commission held a public hearing, and recommended approval with one condition, with a vote of 5-0; there were no public comments.
9. Consider approval of Ordinance No. 2026-068 amending Title 10-17A of the city code amending ADU (Accessory Dwelling Unit) regulations on lots exceeding 11,000 sq ft and clarifications on existing detached structures and health and safety codes. (Case No. 2026-ZRA-006 - ADUs).
BACKGROUND and RECOMMENDATION: Utah state SB 284 was approved in May of 2026 and will go into effect on October 1, 2026. The bill requires some relatively minor modifications to the city code. On July 28, 2026, the Planning Commission held a public hearing on the proposed amendment. No comments were received and the Planning Commission forwarded a positive recommendation with a 5-0 vote.
