NOTICE OF PUBLIC HEARING
Planning Commission
NOTICE IS HEREBY GIVEN that on the 25th day of August 2026 at the hour of 6:00 p.m. of said day in the Council Chambers of Heber City, 75 North Main Street Heber City, Utah the Planning Commission will hold and conduct a Public Hearing to consider:
- An amendment to the Sign Code, limiting the area of signs in the Right of Way to 4 square feet.
- An amendment to allow existing utilities to remain above ground when adjacent property is being developed.
- An amendment to allow food trucks to set up on the street of 200 South between Main Street and 100 W.
- An amendment to the Standard Specifications and Heber City Code regarding water and sewer connection standards for Flag Lots, Commercial and Residential Condominiums, Townhomes and Subordinate Dwelling Units and other individually owned units.
o Summary of proposed amendment:
The city adopted the new Central Heber Overlay Zone (CHOZ) last year. The CHOZ provides more flexibility for infill and redevelopment than past policies and code permitted. The City's Engineering Standards and Specifications, as well as its water and sewer connection codes, are out of date with this new flexibility, as they address all connections as if they are detached single-family dwellings. The proposed policy updates address the new home types and needed flexibility, primarily to have connections to private sewer and water mains. The second issue is the City's Condominium Code is overly restrictive and dissuades multi-family developments from converting into condominium developments. The proposed update simplifies the Condominium Code.
- A Text Amendment to Heber City Code Chapter 18.110 Telecommunications Ordinance.
o Summary of proposed amendment:
Atlas Towers recently modified their contract with Heber City, moving the location of the tower to the cemetery. This will permit the cell tower to be setback over 300' from existing homes. Atlas indicates a need to increase the height of towers to 80 feet to accommodate co-location of 3 carriers, which is a requirement of the Telecommunications Ordinance. The purpose of this meeting is to hold a Public Hearing to consider a formal amendment to the City's Zoning Ordinance, changing the permitted height of cell towers to 80 feet.
If the Public is unable to attend, the Public Hearing comments can be emailed to PCPublic@heberut.gov. All comments may be read aloud during the open-comment portion of the Public Hearing and will be included as part of the permanent public records for this meeting.
