PROCLAMATION DECLARING A DISASTER AND LOCAL STATE OF EMERGENCY IN BOX ELDER COUNTY
WHEREAS, a disaster has already occurred or is imminent in that several areas of Box Elder County have begun to suffer and are continuing to suffer heavy and severe milk production loss due to an outbreak of highly pathogenic avian influenza (HPAI); and
WHEREAS, beginning on or about June 25, 2026, a sample from a dairy farm in Box Elder County, Utah tested positive for HPAI; and
WHEREAS, this pathogen can cause severe milk production loss and has impacted at least 50% of the dairy cows in Box Elder County and almost 50% of the dairy farms in Box Elder County, requiring the quarantine of said dairy farms and dairy cows; and
WHEREAS, personal protective equipment and bio-security measures must be implemented on infected farms; and
WHEREAS, the quarantine of animals and continued monitoring is required for up to 90 days for the pathogen to be removed from infected herds; and
WHEREAS, the magnitude and cost of responding to and recovering from the loss of milk are far in excess of Box Elder County's available resources, making it necessary to call on state and federal resources for financial support and recovery; and
WHEREAS, the United State Department of Agriculture offers funds to impacted milk producers; and
WHEREAS, the Utah Department of Agriculture and Food has a loan program (Agriculture Resource Development Loan) which can be used when a county declares a state of emergency; and
WHEREAS, Box Elder County is a political subdivision of the State of Utah; and
WHEREAS, these conditions constitute a 'State of Emergency' according to local and state statutes, including Utah Code, Title 53, Chapter 2a;
WHEREAS, under conditions constituting a state of emergency, Utah Code § 53-2a-205(a)(ii) authorizes the chief executive officer to take any measures the chief executive officer may consider necessary.
NOW THEREFORE, in accordance with Utah Code § 53-2a-208, on behalf of the citizens of Box Elder County, I, Tyler Vincent, Chairman of the Box Elder County Commission and acting as the chief executive officer of Box Elder County, declare Box Elder County to be in a local state of emergency, requiring the aid, assistance, and relief available in accordance with the provisions of local, state, and federal laws.
I further order that a copy of this order be filed as soon as practicable with the Box Elder County Clerk's Office and with the Utah Division of Emergency Management.
THIS PROCLAMATION is effective immediately and shall remain in effect for 30 days, unless the Box Elder County Commission extends the local state of emergency.
