July 9, 2026 DIVISION OF WATER QUALITY UTAH DEPARTMENT OF ENVIRONMENTAL QUALITY PUBLIC NOTICE OF INTENT TO RENEW A UPDES PERMIT PURPOSE OF PUBLIC NOTICE The purpose of this public notice is to declare the Director of the Division of Water Quality's intention to renew a Utah Pollutant Discharge Elimination System (UPDES) Permit under the authority of the Utah Water Quality Act, Utah Code § 19-5-106(2)(g). The draft Permit and the Fact Sheet (collectively, the draft Permit documents) are available for review and comment. PERMIT INFORMATION PERMITTEE NAME: Canyon Fuel Company, LLC FACILITY NAME: Soldier Canyon Mine MAILING ADDRESS: PO Box 1029, Wellington, Utah 84542 TELEPHONE NUMBER: 435-775-2062 FACILITY LOCATION: Nine Mile Canyon Road, ~12 miles northeast of Wellington, Utah UPDES PERMIT NO.: UT0023680 PERMITTED OUTFALLS: 001, 002, 003 OUTFALL LOCATIONS: 001: Latitude 39o 42' 02' north, Longitude 110o 36' 39' west 002: Latitude 39o 41' 52' north, Longitude 110o 36' 42' west 003: Latitude 39º 42' 09' north, Longitude 110º 36' 38' west RECEIVING WATER: Soldier Creek BACKGROUND The Canyon Fuel Company, LLC - Soldier Canyon Mine (Mine) is an inactive underground coal mine facility with Standard Industrial Classification Code 1222, for bituminous underground coal mining operations. The Mine facility is located approximately 12 miles northeast of Wellington, Utah in Soldier Canyon off Nine Mile Canyon Road. The Mine has been idled with temporarily sealed portals for over 20 years and has had no in-mine dewatering activities during that time. The surface facilities were previously used on a limited basis in support of the nearby Canyon Fuel Company's Dugout Canyon Mine. Currently, the only potential for a discharge is from Outfall 002 at the surface sedimentation pond, which could discharge if there was enough runoff from precipitation events. The last discharge from the Mine resulted from large storm events discharging via Outfall 002 in September of 2013. Otherwise, there have been no discharges from any Outfall since 2013. The Mine has recently started reclamation activities through coordination with the Utah Division of Oil, Gas and Mining and it is unlikely the Mine will be re-activated in the future, however Mine officials desire continuation of the UPDES Permit (Permit) for any potential discharges over the next five years as appropriate. Please refer to the draft permit documents for more information. PUBLIC COMMENTS Pursuant to Utah Admin. Code R317-8-6(6.6), any interested person may submit written comments on the draft permit documents and may request a public hearing if no hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. All comments will be considered in making the final decision and shall be answered as provided in Utah Admin. Code R317-8-6(6.12). Commenters have an affirmative obligation to raise all reasonably ascertainable issues and submit all reasonably available arguments and factual grounds supporting their position, including all supporting material. Supporting material must be included in full and may not be incorporated by reference, unless the material is already part of the administrative record. Public comments are invited any time prior to the deadline of the close of business on August 10, 2026.
