Amalga Planning and Zoning Minutes July 1, 2026 7:00 PM 6590 N 2400 W Amalga, Utah Meeting Convened 7:04 PM 1. Roll Call Visitors: Mike Bouck, Ty Bailey, Bryan Rindlisbacher, Mat Turner, Ed Dursteler, Mike Morley, Diane Morley, Shawn Hansen, Stephanie Hansen, Randie Porter, Craig Peterson, Jerry Munk, Graiselda Falslev, Kurt Falslev, Jared Wiser, Mayor David Wood Commission Members: Kelly Noble, Acting Chair, April Hansen, LeAnn Campbell, Aaron Wood, Rayslyn Larsen Town Board, Dave Lee Secretary 2. Minutes of June 3, 2026. Motion to Approve-April Hansen Second-LeAnn Campbell Motion Carried 3. Mike Bouck asked for some time. Four items to consider: Unclear as to what the plan is, and what is the plan? Plans were brought up from the town website. Based on plan, it would be the largest truck stop in Cache Valley. Comparisons were made with 10th West Maverik, Wellsville Maverick, and Franklin Maverik. The last two don't allow overnight parking. Whatever is being proposed is being mis-classified as a gas station. Placement of 7.4.1e. Listing objectives, then e is put in as a specific type. Would like to see this revised, and another section added that handled permitted uses. Zoning Clearance. Does Charlie have the necessary documents for a Zoning Clearance. 3.31 allows for a car wash, is this included and do we have the water for it? Does the town have to provide water line and fire hydrant? Septic system? Bear River Board of Health handles septic permits. Open 3.31 and add some things: Hours of operation Lighting Fuel Delivery External Speaker Boxes Recessed Lighting Trash Enclosure Conflict of Interest Question Encourage Town Board to rescind the ordinance and redo it because of a conflict of interest. Kelly Noble commented on the lack of interest in the process. Rayslyn Larsen-Truck bays were from the artist's conception. Water usage was also discussed. Carwash is not now in the plan. P&Z does not control the hours. This would be something for the town board to deal with. Rayslyn addressed several issues. Mike Bouck-Town plan encourages agriculture, not truck stops. Appreciative of the work of P&Z. Asked to have a paper included in the minutes. That follows this narrative in bold print. Amalga Town proposal for a truck stop. 7-1-26 1. A Misclassification of Scale This proposal is being presented under the guise of a standard convenience store. It is not. Based on the number of truck stalls, this would be the largest truck stop in Cache Valley. (24 Truck parking stalls, 4 acres) For comparison: o 36% larger than the LW on 10th West in Logan. (13 stalls, 2.25 acres) o 40% larger than the Wellsville Maverik. (technically does not have stalls so this is a generously conservative number, 3.5 acres) o 100% larger than the Franklin or Logan 10th West Maveriks (neither allow overnight truck parking and do not have truck parking stalls, 1.91 and 3.21 acres respectively) Action - P&Z needs to get a hard copy of the plan of what is being proposed 2. Placement of 7.4.1e 'Automotive Fuel Service Station/Convenience Store' this is definitely out of place. This section is addressing 'basic objectives'. The 'Automotive Fuel Service Station/Convenience Store' should be under a new section called 'permitted uses' in section 7.4 - The 'light industrial' section. Note - Review the history of the request for light industrial. f. 'unless listed in this chapter ' Gas station is the only one listed in this chapter. Action - P&Z needs to revise the placement of 7.4.1e and create a new section in 7.4 titled 'Permitted Uses' 3. Conflict of Interest. Collette Dursteler should have abstained from voting. Action - P&Z needs to encourage the Town board to rescind the ordinances passed and redo the process. 4. Zoning Clearance - Does Charlie have the necessary documents to prove that he is ready for Zoning Clearance? i.e. does he have a Traffic Impact Study from UDOT? Has he submitted a building plan? From last week's meeting this was very unclear. Does the plan include a car wash? Does the town have to provide water and fire hydrant? Action - P&Z needs to review the plans submitted and make sure they meet the requirements of the new code in 3.31 Even if we set aside the truck stop issue and look at this strictly as a standard passenger gas station, this ordinance is missing protections for Amalga Town. It has no standards for site landscaping, no surface-water filtration for parking lot runoff, no trash enclosure rules, and no plan for snow storage. The town lacks the necessary detailed criteria to issue a thorough zoning clearance tonight because the code we are relying on is incomplete. We should table the zoning clearance until these basic standard gaps are corrected.' Gaps in 3.31 in the town code. 1- Restricted Hours. This gas station should not be open 24/7 in addition to limited hours, the following services should be limited to hours from 5:00 AM to 11:00PM a. Lighting - this applies to all lighting b. Fuel deliveries by large tanker trucks. c. Trash collection and dumpster emptying. d. External speaker boxes or outdoor intercom use. 2- Stormwater Pollution Prevention Plan (SWPPP) & Surface Runoff a. There is no SWPPP - Gas station parking lots collect continuous drips of motor oil, antifreeze, and brake fluid from everyday traffic. Standard codes require a site-wide drainage plan, including oil-grit separators for the entire parking lot storm drain system before it discharges into the town's ditches or water systems. 3- Strict Lighting Compliance for the Whole Site. a. Section 3.31.4(d) correctly mandates that lighting underneath the canopy must be recessed. But it does not define rules for the rest of the site's pole-mounted parking lot lights. 4- Trash Enclosure and Solid Waste Standards a. Section 3.31.13(c) mentions keeping combustible waste in covered metal receptacles, but the code lacks standard zoning rules for retail trash dumpsters. Commercial trash dumpsters be enclosed within a three-sided masonry structure that matches the architecture of the main building, complete with heavy gates. Without it, standard gas station dumpster trash Kelly-It's important for the community to be involved with P&Z, otherwise it's just 5 people making decisions for everything. Rayslyn-Our book did not address the things that were being proposed. We couldn't say yes or no, because we did not have the doctrine to address the situation. 4. Zoning Clearance Application from Kurtis Falslev for a home on the old Jorgenson property across the street from 2905 West 5700 N. This home will be on the other side of the canal. There is a question about how this will fit in with the Cache Canal. It also abuts the Wetlands Zone. This presents questions; right of way with the Canal Company, the town wetlands map disagrees with the Army Corp of Engineers map according to Kurtis. There are enough questions about this that P&Z feel like they need to have more questions answered before they can make a decision. Secretary will contact Canal Company for information. Motion to Table-LeAnn Campbell Second-Aaron Wood Motion Carried 5. Zoning Clearance Application for the Automotive Fuel Station/Convenience Store of Charlie Erickson, represented by Ed Dursteler, at 2900 W Hwy 218. Building will be 18 feet high. Many of the questions brought up earlier will be addressed by the town board at licensing. Septic was discussed. Setbacks were reviewed as per plans made available. Motion to Approve-LeAnn Campbell Second-Aaron Wood Motion Carried Due to the fact that our meeting scheduled for August 5, 2026, conflicts with the Cache County Fair, and several members of the board have children that show animals, a Motion to move the meeting to Tuesday, August 11, 2026, at 7:00 PM was made by April Hansen Second-Aaron Wood Motion Carried Presentation of forms from Shantrell Ritter so members of P&Z can be paid $25.00 for each P&Z meeting attended. Secretary will get the form to Nate Noyes. Forms to be returned to Shantrell by 8/1/26.
