CITY OF MOAB EMERGENCY PROCLAMATION 2026-01 MAYOR'S DECLARATION OF LOCAL EMERGENCY Moab City residents face existing hazardous environmental conditions within Moab's municipal boundaries that justify a temporary city-wide ban on the discharge of fireworks within the City's boundaries. Moab City's Chief Executive Officer, Mayor Joette Langianese, ('the Mayor') is authorized to declare a local emergency pursuant to Utah Code Subsection 53-2a-203(5) 'to save lives and protect property in response to a disaster, or to avoid or reduce the threat of a disaster' and finds the disastrous threat of fire is imminent within the city-wide boundaries and has required additional assistance to supplement the response . . . of the City. Utah Code Subsection 53-2a-208(1)(a). Pursuant to Utah Code Subsection 53-2a-203(1)(a)(ii), the Mayor exercises her broad powers 'to take additional measures [considered] necessary to mitigate, prevent, or respond to the disaster,' including a city-wide ban on the discharge of fireworks. The fireworks ban excludes the City- and Grand County-sponsored annual fireworks display at dusk on Saturday, July 4, 2026, near Sand Flats, which will continue. On June 23, 2026, at the City Council Meeting, the Moab Valley Fire Protection District ('MVFPD') Division Chief identified critical fire conditions that present 'explosive fire spread,' including the dead fuels, Cottonwood Fire in Beaver, Utah, which reached 25,000 acres just overnight, the Iron Fire, weather station reports of no precipitation in 25 days, and 15 Red Flag warnings in June. Due to the prolonged drought and extremely dry vegetation, the National Park Service ('NPS') likewise declared that Arches National, Canyonlands National Park, Hovenweep National Monument, and Natural Bridges National Monument must comply with increased fire restrictions to go into effect at 12:01 am on Friday, June 26, 2026. MVFPD also reported that the State of Utah intends to issue a Level 2 fire restriction which prohibits any open fires on unincorporated land, private land, and state land on Friday, June 26, 2026. At the Moab City Council Meeting, the Mayor announced her intention to declare by proclamation a local emergency, effective immediately upon preparation and distribution on June 24, 2026, based upon the City's findings and information provided by the MVFPD and NPS. The City Council unanimously concurred with her decision. All residents, public officials, and public works crews have taken measures to mitigate and prevent fire damage and must comply with the city-wide prohibition of fireworks. These hazardous fire conditions have the potential to worsen, and have worsened, and immediate attention is needed to ensure the safety, health, and welfare of the citizens of the City of Moab. On June 24, 2026, the Mayor executes this Emergency Proclamation 2026-01 to declare a local emergency pursuant to Utah Code § 53-2a-205 and Subsection 53-2a-208(3). NOW, THEREFORE, BE IT PROCLAIMED THAT: 1. Nature of the Local Emergency: A local emergency exists for the City of Moab due to the hazardous fire conditions, the impacts of which threaten and affect the entire City. The City requires additional assistance to supplement the earlier response and recovery effort . 2. Emergency Powers and Operations: The City of Moab's emergency powers and operations are hereby invoked and City personnel and resources are ordered and authorized to perform all functions authorized by federal, state, and local law to address this local emergency, including but not limited to those actions authorized under Utah Code § 53-2a-205. 3. Assistance: The City of Moab is authorized to request all assistance available with respect to this local emergency from all federal, state, and local sources, and is authorized to participate in or enter into any mutual aid agreements. 4. Term: The Emergency Proclamation is set for 30 days until July 25, 2026, and may be extended pursuant to Utah Code Ann. Subsection 53-2a-208(6)(b)(ii) and (iii) by the majority vote of the City Council. 5. Dissemination: This Emergency Proclamation 2026-xx will be: (a) filed with the Clerk of the City of Moab pursuant to Utah Code § 53-2a-209; (b) posted to the City of Moab's website, the Utah Public Notice website, and applicable City social media accounts as determined by the City Manager, and (c) delivered to Grand County and the State of Utah.
