Planning and Zoning Pending Minutes for June 3, 2026 The Planning commission met on Wednesday, May 6, 2026 at the public safety building located at 130 W. Main in Cleveland, Utah at 7:00 pm. Those present were commission members: Nancy Livingston, Lowell Gardner. Logan Ellis and Dylan Horrocks were on the phone. Tyler Rowley was absent. Council Member Kristen Vose was not in attendance. Public attendees: Deanna Murray, Mrs. Debbie Wells, Levi Maughan, and Lacey Maughan The Meeting was called to order by Lowell Gardner at 7:10 pm. Pledge was led by Lowell Gardner. Minutes: Minutes were not approved. Public Comments: None. Came back to comments with Debbie Wells due to not being on the agenda. She gave information about wanting to put a modular on her property where an old cabin located north on 650 West existed that had water and septic tank, which they tore out. Has concerns about fire protection back in that area due to narrow road. She will make an application to get sewer. She wants to know what to do for a building permit. Chair Lowell Gardner explained that she will need to come next month in July with a plat map of where modular will go to get zoning approval, then she will go to county for permit. Water and sewer go through Town, with fees and paperwork to fill out. Castle Valley Special Service District will need work order to do sewer and check water meter currently on property. Action Agenda: Item #1 Discuss/Approve/Deny Deana Murray wants a business license for a home business. Deana Murray stated that she did not need a business license now because she is working with Small Business Administration and she is completely online and listed as LLC. She wanted her Mother, Debbie Wells to take her place since she did not need it. Chair Lowell Gardner explained that we could not take any action on her wanting to put a modular in because she is not on the agenda and cannot just fill in for someone else's business item. All Debbie Wells comments will go in Public Comments. Item #2 Discuss/Approve/Deny Moving Planning & Zoning meetings to first Thursday of the month starting in July. Chair Lowell Gardner explained that Tyler Rowley now has a conflict with coming on Wednesday, so it was proposed to move to first Thursday of month. Nancy Livingston made a motion to move the Planning and Zoning meeting from first Wednesday to the first Thursday of the month. Second by Logan Ellis. All were in favor, motion passed. Item #3 Discuss/Approve/Deny about 2-5-2.5 #2 with property owner of 90 South 300 West. Chair Lowell Gardner explained that the City Council had asked that we discuss the issue with the shed on their property. In the letter sent there were 3 items of noncompliance. Shed is now in compliance with 2 of the items. The third item still not in compliance with the 25-foot triangle. Using point from where driveway and road meet down the road east 25 feet then draw line from that point back to the point where driveway ends at house. There should be nothing in that triangle to obstruct view. Lowell Gardner drew a picture to show Maughan's what the ordinance was stating. Could move east if there is room to bring it into compliance. Levi Maughan stated that they were also thinking of putting in a fence on that side of their property so it would help with kids running into road. They will come to Planning & Zoning to get zoning approval for fence so they could get permit for it. Item #4: Adjourn Meeting: Nancy Livingston made a motion to adjourn. Dylan Horrocks seconded.
