For the proposed project relating to the Hinckley Sewer Lagoon Rehabilitation (project) in Hinckley, Utah.
The Utah Division of Water Quality (Division) has conducted a review of the proposed Project in accordance with State and Federal procedures for implementing the National Environmental Policy Act (NEPA), (40 CFR Part 6). The Division has determined that this Project is eligible for a categorical exclusion. Accordingly, the Project is exempted from further substantive environmental review requirements under NEPA.
The following is a brief description of the proposed action and a brief statement of how the proposed project meets the criteria for a categorical exclusion.
Hinckley Town intends to split its existing primary 7-acre lagoon cell into two 3.4-acre cells, which can both act as primary cells, by desludging the lagoons and constructing new dikes, along with transfer and inlet structures, piping, riprap, clay liners, and all related work. Excavated material for this project will come from onsite, directly adjacent to the lagoons.
This project meets the criteria for granting a categorical exclusion because the proposed project is for the rehabilitation of existing facilities; and does not contain any of the excluding factors under 40 CFR 6.204(a)(1)(ii).
