Enforcement Council Labor Commission, 160 East 300 South, Salt Lake City March 24, 2026 - 9:30 a.m. Council Members Present: Chris Hill, Chair Deputy Commissioner, Labor Commission Todd Jenson Assistant Attorney General Angie Hillas Director, Income Tax and Education Division, Utah State Tax Commission Mike Miller Unemployment Insurance Division, Department of Workforce Services Justin Williams Unemployment Insurance Division Director, Department of Workforce Services Council Members Excused: Allyson Pettley Bureau Manager, Division of Professional Licensing, Utah Department of Commerce Visitors: A list of visitors is provided at the end of the Minutes. Topic Discussion Action Welcome and Approval of Minutes Chair Hill called the meeting to order at 9:31 a.m. and welcomed everyone. Angie Hillas introduced Marisela Chavez who will be replacing Angie and representing the Utah State Tax Commission. Chair Hill and the committee members welcomed Marisela to the Workers' Classification Enforcement Council. Chair Hill moved to approve the December meeting minutes. Justin Williams motioned to approve the minutes. Chair Hill seconded the motion. All were in favor. Business Legislative updates Misclassification Issues Presentation Next Meeting Public Comment Closed Meeting Opened Meeting None Chair Hill stated HB 396 passed and asked Mike Miller what impact the bill will have on this committee. Mike Miller stated they have been instructed to move all penalties and interests related to unemployment insurance into rules where they can be defined. He stated they have also been instructed to create a new section penalizing the employers who misclassify workers. Chair Hill asked the committee if there was any other legislation that would impact the committee. The committee was not aware of any legislation at this time. Chair Hill emailed the labor commission spreadsheet, noting that Krystal Smith is handling these cases. Chair Hill also noted there are about 62 new cases that have been received this quarter. Krystal stated she saw a trend around increasing tax implications causing concern. Mike Miller and Justin Williams did not notice this trend in the last quarter. Marisela Chavez stated she has not noticed a trend relating to misclassification. Krystal also mentioned she has received multiple complaints from an outside company, not a Utah based company, named Patriot Grass Roots. The complaints were in relation to the company bringing in people to gather signatures to appeal Prop 4, feeling people were misclassified. Chair Hill offered June 9, 2026, at 9:30 a.m. for the next meeting. Future meeting schedule proposal: June 9, 2026 September 8, 2026 December 8, 2026 None Chair Hill motioned to close the open meeting. Justin Williams seconded the motion. All were in favor. The meeting adjourned at 9:43 a.m. Chair Hill opened the meeting at 9:50 a.m. Chair Hill motioned to close the meeting. Justin Williams seconded the motion. All were in favor.
