Present: Commission Chair Chad Veater, City Recorder Tyrissa Howell, Commission Members Jaynie Connor, Garrett Wolfley, Jon Torgerson, Clint Albrecht, and Tracy Wright.
1. Adoption Of The Agenda
Motion to adopt the agenda was made by Jon Torgerson and seconded by Jaynie Connor. The motion carried unanimously.
2. Approval Of The Minutes
Members confirmed they had received and reviewed the minutes from the previous meeting. No corrections were noted.
Motion to approve the minutes was made by Garrett Wolfley and seconded by Jaynie Connor. The motion carried unanimously.
3. Conditional Use Permit - The Farmstand At 350 S 100 W
The Commission considered a Conditional Use Permit for The Farmstand, a home-based food sales operation located at 350 South 100 West.
Commission Member Tracy Wright provided background on the applicable regulatory framework. She reported that she had spoken with the applicant, Jessica Henrie, earlier that day, and confirmed that the operation falls under Utah's Home Consumption and Homemade Food Act. Jessica confirmed that all required labeling stickers would be placed on food items and that the required signage - stating that food items offered for sale are homemade and have not been inspected, certified, licensed, or regulated by state or local authorities - would be posted and visible.
Tyrissa Howell also noted that she consulted with the local health department inspector, who confirmed that a health department permit is not required under the applicable statute of House Bill 181.
Motion to approve the Conditional Use Permit and forward it to City Council was made by Garrett Wolfley and seconded by Jon Torgerson. The motion carried unanimously.
4. Adjournment
Motion to adjourn was made and carried unanimously.
