Purpose of Public Notice
The Utah Department of Environmental Quality (DEQ) is soliciting comments on the request to issue a draft Operator Certification Decision as described below. The draft Operator Certification Decision is issued by the Director of the Division of Water Quality under authority of the Utah Water Quality Act, Utah Code 19-5-106(g) and Utah Admin. Code R317-16-6. Under Utah Code 19-1-301.5, effective May 8, 2012, a person who wishes to challenge a Permit Order may only raise an issue or argument during an adjudicatory proceeding that was raised during the public comment period and was supported with sufficient information or documentation to enable the Director to fully consider the substance and significance of the issue. Waterleaf Resources, LLC has requested a draft operator certification decision (No. UTGSL-OCD-001) to cover the operation of lithium extraction from Gunnison Bay, Great Salt Lake (GSL), at its Great Salt Lake Lithium Project Commercial Plant in Box Elder County, Utah. Public Comments
Public comments are invited at any time prior to 17, July, 2026. Written comments may be directed to the Division of Water Quality, PO Box 144870, Salt Lake City, UT 84114-4870. All comments received prior to close of business on 17, July, 2026, will be considered in the formulation of final
determinations to be imposed on the operator certification. Public Hearing: From Utah Admin. Code R317-16-6(4): 'The director may, at the director's discretion, hold a public hearing to take oral comments if: (a) the director receives a request in writing not more than 15 days after the publication date of the draft certification decision; and (b) the request is from: (i) another state agency; (ii) ten interested persons; or (iii) an interested association having not fewer than ten members'.
