Dinsdale Water Company Inc. hereby gives notice under Utah Code Ann. § 57-13a-104 that it intends to permanently abandon that portion of its prescriptive easement, and the ditch thereon, that is located on the following parcels in Weber County, State of Utah:
Parcel ID Nos.: 12-127-0051 and 12-127-0046 which is more particularly described as: Parcel 12-127-0051:
'Beginning at a point on the west right of way line of Wall Avenue; said point being South
01°21'21' West, along said West Right of Way Line, 20.06 feet from the Southwest Comer of the intersection of 17th Street and Wall Avenue; said point also being South 1°21'21' West, 57.06 feet and North 88°38'39' West, 40.00 feet from the Center Line Intersection of 17th Street and Wall Avenue; and running thence South 1°21'21'' West, along said West Right of Way Line of Wall Avenue, 814.81 feet to a point on the Northerly Bank of the Ogden River; thence along said Northerly Bank of the Ogden River the following three
(3) courses: thence North 83°26'47' West, 205.86 feet; thence North 82°13'20' West,
161.76 feet; thence South 60°15'51' West, 272.36 feet; thence North 1°20'51' East, 725.34 feet; thence North 88°38'39' West, 75.00 feet; thence North 1°21'21' East, 185.03 feet to a point on the Southerly Right of Way Line of 17th Street; thence along said Southerly Right of Way Line of 17th Street the following four (4) courses: thence North 86°21'21' East, 370.51 feet; thence South 1°21'21' West, 9.37 feet; thence South 88°38'39' East,
293.00 feet; thence South 38°07'49' East, 18.87 feet to the point of beginning. Less and excepting: a parcel of land in fee, being part of an entire tract of land, situate in the Southeast Quarter Southwest Quarter of Section 20, Township 6 North, Range 1 West, Salt Lake Base and Meridian, in Weber County, State of Utah. For the widening of State Route 204 incident to intersection improvements to 1 Street and State Route 204 (Wall Avenue), known as Project S-0204(0)3, the boundaries of said parcel of land are described as follows: beginning in the Easterly Boundary Line of said entire tract at a point which is
57.02 feet (57.06 feet by record) South 1°21'21' West along the Monument Line of said State Route 204 and 40.00 feet North 88°38'39' West from the Center Line Intersection of 17th Street and said State Route 204; said point also being 628.41 feet North 1°21'2l' East along said Monument Line of State Route 204 and West 40.00 feet from the Ogden City Monument at the intersection of State Route 204 and 18th Street; and running thence South 1°2l '21' West 11.96 feet along said Easterly Boundary Line to a point which is 40.00 feet perpendicularly distant Westerly from the Control Line of SR-204 of said Project at Engineer Station 16+15.50; thence North 88°38'39' West 16.00 feet to a point which is
56.00 feet perpendicularly distant Westerly from said Control line at Engineer Station
16+15.50; thence North 32°48'13' West 32.06 feet to the Northerly Boundary Line of said entire tract at a point which is 74.00 feet perpendicularly distant Westerly from said Control Line at Engineer Station 16+42.03; thence along the Northerly and Northeasterly Boundary line of said entire tract the following two (2) courses and distances: (1) South 88°38'39' East 22.00 feet; thence (2) South 38°07'49' East 18.87 feet to the point of beginning as shown on the official map of said project on file in the Office of the Utah Department of Transportation. The above described parcel of land contains 576 square feet or .013 acres. Note: Rotate the above bearings 0°03'28' counterclockwise to equal Project (NAD83) bearings. Parcel 12-127-0046:
'A part of the Southwest Quarter of Section 20, Township 6 North, Range 1 West, Salt Lake Base and Meridian, U.S. Survey: Beginning at a point 1400.30 feet South 89°11' East along the Section Line from the Southwest comer of said Section 20; and running thence North (North 0°58' East) 384.63 feet to an existing boundary line fence; thence South 89°18' East 215.00 feet along said fence line; thence South (South 0°58' West) 385.07 feet to the section line; thence South 48°31'53' West 291.31 feet to a point South (South 0°58' West) from the point of beginning; thence North (North 0°58' East) 196.00 feet to the point of beginning,' in Ogden City, Weber County, Utah'.
The approximate location of the unrecorded prescriptive easement located on Parcel ID Nos. 12-127-0051 and 12-127-0046 that Dinsdale Water Company Inc. intends to abandon by this Notice is set forth in Exhibit A, which is attached hereto and expressly incorporated as part of this Notice.
This Notice applies solely to the prescriptive easement located on the above-identified parcels, as identified in Exhibit A. Nothing in this Notice abandons or relinquishes any right or claims by Dinsdale Water Company to any other prescriptive easements, or any portions of prescriptive easements, that are not located on the above-identified parcels and depicted in Exhibit A. This Notice is not intended to impact or affect any other easements located on the above-identified parcels.
