PUBLIC NOTICE TO ISSUE A SECTION 401 WATER QUATLITY CERTIFICATION
PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare the State of Utah's intention to issue a Section 401Water Quality Certification with Conditions under the authority of the Federal Clean Water Act (33U.S.C. ยง 1341), and consistent with the Utah Water Quality Act, Title 19, Chapter 5, Utah Code and Utah Administrative Code R317-15.

BACKGROUND
The U.S. Army Corps of Engineers (USACE) Sacramento District proposes to issue a Regional General Permit (RGP) for National Energy Emergency Activities. This RGP was developed in response to Executive Order (EO) 14156, which declared a National Energy Emergency on January 20, 2025. The proposed RGP will authorize a range of activities, including but not limited to construction, maintenance, and repair of mining or drilling facilities, electric and gas facilities, transmission pipelines, energy storage sites, and related infrastructure such as access roads and docks. The permit applies within the Sacramento District's boundaries, which encompass the Central Valley and Sierra Nevada regions of California, as well as areas in Nevada and Utah. Once an individual activity is authorized, the proponent has three years to complete it. Each single and complete project must not result in a permanent loss exceeding 1.0 acre of wetlands, 2.0 acres of lakes or ponds, or 500 linear feet of stream. For permanent losses greater than 0.1 acre, compensatory mitigation at a 2:1 ratio is required. Proponents must submit a pre-construction notification (PCN) through the Regulatory Request System and may not begin work until receiving written verification from the Corps.

Public comments are invited any time prior to the deadline of the close of business on May 11, 2026. After considering public comments the Utah Division of Water Quality may execute the Certification issuance, revise it or abandon it.
