3. Zoning Clearance Application from Chandler Scholle for a home at approximately 7901 N 2400 W, Parcel # 13-014-0025. This is the southern most of the three lots that belonged to Brad Noble. Commission reviewed the plans and setbacks were approved. Mr Scholle paid the Zoning Clearance Fee and the Impact Fee.

4. Charlie Erickson brought in more plans for a Convenience Store/Gas Station. He had three plans prepared: 'Town of Amalga-Staff Report', 'Utah Model Zoning Ordinance: Rural Highway Commercial Truck Stop District', and 'Draft Zoning Ordinance for Amalga, Utah/Rural Highway Commercial-Truck Stop (RHCTS) Zone'.
The Utah Model(UM) is one we could build the ordinance from, this one is more specific.
The Staff Report(SR) ties what they are trying to do to the model. This was designed to be in compliance with the code.
Charlie walked us through the SR.. He originally planned on a 24/7 operation, but changed to letting the community determine the hours by the usage.
Economic Development-This is the pitch as to why the town would want it. What was not included on this was 'proper use of the land'. It's not really good agricultural land.
Strategic Location in Cache Valley. UDOT would be heavily involved. A slight development of the road on the west side. Little or no disruption on the North side of the road. The intersection would be at 3000 W Hwy 218. It would have to have dedicated turn lanes to be approved. Speed limit would be determined by UDOT. No light is planned. UDOT has easement all along 218. Turn lanes would be wide enough to accommodate large trucks. Something similar to the turn in for Schiebers just up from the Bear River. Where this is a State Road, it is in control of UDOT regulations.
Protection of Agricultural and Residential Areas. This is where the proposal would start to match the City Code.
Local Control and Predictability
Alignment with Utah Planning Practices These items would need to be spelled out and not just assumed. Question was asked if an ordinance change for this zone, or could it be proposed under a general category? Answer was Town would decide that. It was voiced that the Town needs to be the driving force behind any ordinance change. Charlie said he wanted to provide a skeleton for the Town to flesh out.
It was brought up from our last meeting with the Town Attorney that the more general you make something, the easier it is to deal with. The more precise, the harder it is.
Charlie said he has given us a shorter framework and a longer framework and then essentially, he has applied for it. Charlie recognizes that this won't happen overnight. He is dealing with gas company, electrical, etc.
He also suggested that under a Conditional Use Permit the Business Plan could be submitted. You would get a lot of the particulars.
He also mentioned lighting and a Utah Dark Sky requirement.
5. Colton Oryall came in with a complaint about Petersen Excavating not living up to the Conditional Use Permit(CUP) they received from the city. Members of the commission received copies of the applicable information regarding P&Z's involvement with granting the CUP. We also reviewed what the Town Board passed in their meeting. There was a lengthy discussion on what was happening. The Town Board in charge of Business Licenses. Mr. Oryall doesn't feel that the CUP is being enforced. He listed the items not being adhered to-Piles of dirt over 20' high, piles of dirt not being sprinkled to keep the dust down, the concrete retaining wall was never completed, and has been dismantled in some places. This has been passed on to the Town Board for their review.
