The meeting was called to order at 4:02 PM by Ms. Marvidikis, acting Board Chair.
First Item of Business - Approval of Minutes
Minutes from the January 15, 2025 meeting were presented. No additions or changes were noted. Mr. Fallon made a motion to approve; Mr. Kourianos seconded the motion. The motion passed.
Second Item of Business - Dale Terry, Proposal for Hillside Villa Canal Access Road Modification
Mr. Terry presented a 2019 engineering plat prepared by Jones & DeMille Engineering, showing a proposed right-of-way extending from 300 North, running east into Housing Authority property, and then turning southwest along the Price-Wellington Canal Road.
Mr. Terry explained that he is in the process of obtaining permits to build a home on his property, located south of the Housing Authority property boundary and east of the canal road. The current access road to the canal branches off from 300 North and runs southwest through Mr. Terry's property to the canal road. He proposed modifying the access road as reflected on the plat map. Mrs. Hansen noted that Mr. Terry had previously stated that the plat showing the right-of-way was never recorded, which Mr. Terry confirmed. She further clarified that the Housing Authority purchased the property east of the canal in 2020; at the time the engineering plat was created, the property owner was listed as Price City. Mr. Terry stated that, until the morning of February 19, he was unaware that the property was now owned by the Housing Authority. Mr. Kourianos added that Mr. Tatton of Price City did not bring this ownership change to his or Mr. Terry's attention during a previous meeting. Mr. Terry expressed concern that the engineering drawing could not now be recorded without permission from the current property owner. Mrs. Hansen confirmed that the plat could not be recorded without such permission, and Mr. Terry agreed.
Mr. Terry further explained that Mr. Tatton had informed him that a building permit could not be issued unless the plat was recorded. Mrs. Hansen questioned the accuracy of that statement. Mrs. Marvidikis also expressed confusion and asked whom they had spoken to at the City. Mr. Kourianos stated that they had spoken with Todd Thorne and Mr. Tatton of Price City. Mr. Kourianos explained that Mr. Tatton's primary concern was maintaining access to the canal floodgate located on Mr. Terry's property, which was identified on the map for Ms. Marvidikis.
Mrs. Hansen stated for the record that the proposed access road would also serve as the primary access to the new home Mr. Terry intends to build. Mr. Kourianos inquired whether the Housing Authority property lines might extend farther south than previously believed, potentially including the current access road. Mrs. Hansen responded that the property lines had been staked on-site and confirmed that the boundary lies north of the existing access road.
Ms. Marvidikis clarified that the proposed road would therefore constitute an easement along the property line.
Mrs. Hansen then noted that Mr. Terry had previously informed her that the slope of the current access road does not meet City standards for emergency vehicle access, which is preventing issuance of a building permit. She further stated that, to meet City specifications, the road would need to be constructed at a greater angle than shown on the plat, extending farther into Housing Authority property to comply with slope requirements. Mr. Terry agreed.
Mrs. Hansen also noted that no right-of-way currently exists on Housing Authority property. Two access roads exist on adjacent properties: one on Mr. Terry's property and another north of the housing complex providing access to Price City's utility switchyard.
Mr. Kourianos then discussed the setback from the property line to the road, estimated at approximately 30 feet. Mr. Terry stated that if he were to reconstruct the current road on his property, he would still be required to maintain a minimum 10-foot setback from the Housing Authority property line. Mrs. Hansen added that the road would need to be approximately 60 feet wide to meet City emergency vehicle requirements. Ms. Hansen also reported that, after consulting with the canal company, they indicated no objection to the proposal provided they retain access and the road running parallel to the canal is not modified.
Ms. Marvidikis suggested that the Board members visit the property to view the proposed modification, and it was agreed that the matter would be discussed further at the next meeting. Mr. Kourianos clarified that this agenda item was intended for informational purposes only and at the next Board meeting it would be approved. Mrs. Hansen stated she would coordinate with Board members to schedule a site visit.
Third Item of Business - Financial Statements
Financial statements for December 2025 were presented. No questions were raised, a motion to approve was made by Mr. Kourianos; Mr. Fallon seconded the motion. The motion was passed.
Fourth Item of Business - Resolution #112-26, Amendment to Articles of Incorporation, for Entity Legal Name Change
Mrs. Hansen explained that although the Emery County Housing Authority was absorbed by Carbon County and the organization has since operated under the name 'Housing Authority of Carbon-Emery County,' the legal entity name has not been formally amended.
Resolution #112-26 authorizes amendment of the Articles of Incorporation to reflect the official name change. Upon completion, the amendment will be filed with the State of Utah, the Internal Revenue Service, and the U.S. Department of Housing and Urban Development (HUD).
Mr. Kourianos called for a motion to approve the resolution. The motion passed unanimously.
Fifth Item of Business - Other Business
Mr. Fallon reminded the board that SERDA will be having a round table discussion at their office in Price about local housing issues on April 8th. Mr. Fallon noted he is planning on attending. Mrs. Hansen noted that she and three other employees will be attending, as they have many questions and would like to share their insights.
No other questions were raised. A motion to adjourn was made by Mr. Kourianos, the motion was seconded by Mr. Fallon. The meeting adjourned at 4:24 PM.
