Minutes of Regular Town Board Meeting Held January 22, 2026 The meeting was held at the Oak City Town Hall beginning at 7:45 p.m. in the Conference Room. The following were in attendance: TOWN OFFICIALS Mayor Kirt Dutson Council Member Shawn Gonder Council Member Tom Nielson-Absent Council Member Copeland Anderson Council Member Jared Rawlinson Town Deputy Recorder Karen K. Lovell Town Treasurer Courtney Finlinson Town Recorder Alyssa Nielson Town Public Works Specialist Ben Nielson OTHERS Dale Pratt Nick Bauman Dave and DeAnn Steele Barry Anderson Mayor Dutson gave an invocation. The following Agenda items were considered: A. Adopt Agenda. Karen pointed out that the adoption of the December Meeting showed it was a Regular Meeting and it was a Public Hearing and Regular Meeting. Copeland moved, seconded by Shawn, to adopt the Agenda as amended. Roll Call Vote: Mayor Dutson-Aye. Tom-Absent. Copeland-Aye. Shawn-Aye. B. Adopt Minutes of Town Board Public Hearing and Regular Meeting held Thursday, December 18, 2025. Copeland moved, seconded by Shawn, to adopt the Minutes as written. Roll Call Vote: Mayor Dutson-Aye. Tom-Absent. Copeland-Aye. Shawn-Aye. C. Discuss and Appoint the following Town Positions, Vote and Swear in Courtney Finlinson as Treasurer, Alyssa Nielson as Recorder, and Karen Lovell as Deputy Recorder. Karen swore in Alyssa and Alyssa swore in Karen and Courtney. D. Discuss ERC and Impact on City Water Connections and Annexations. The Mayor pointed out that we have enough water source to supply 259 houses and we currently have 312 houses. There was a water master plan done in 2021 and he asked Ben Nielson to report on the meter usage and how it affects the ERC. Ben found that there were 42 connections that were high use and almost 24 million gallons was used by these 42 users. He gave the Mayor a copy of his report but stated that it is not a totally accurate report as it is just an estimate of water usage and it doesn't take into account the Park or Cemetery water usage. The findings actually make the ERC worse. The Mayor pointed out that the Town is obligated to have enough water to supply all current connections and lots with the city. His concern is adding more connections when the Town can't meet the need for the current in-town needs. Ben pointed out that it was recommended some time ago that the Town do a new Well. It has been discussed many times but never completed. Dave stated that the Town had seriously considered it but got side tracked with the ASR Recovery system. There has been quite a bit of preliminary work done on looking at a new Well, however. Deann Steele, past Oak City Town Treasurer, said there were people that would call to find out when the Town was going to start reading the meters again and when it would stop and they would, most generally, start running their outside water that entire time. Ben stated that there was one party that ran enough water through the winter on his system that it ruined all the fittings and parts on his system. The Mayor talked to someone who has water he would sell to the Town. He would probably be willing to negotiate a fair price. For now, the Mayor would like to see a moratorium on annexation until the Town can get a handle on the water situation. Who knows how much water the Town will get from Dry Creek and Cold Water Spring this year. Courtney asked if the Town were to start charging through the winter, would it bring in enough money to buy the additional water the Town needs? It would help but would not take care of the entire problem. Before charging for water in the winter, the Mayor wanted to see what the Town's chances are of getting some kind of grant. Ben explained that it is pretty hard for the Town to qualify for grants due to the Town's high Modified Adjusted Gross Income (MAGI). Courtney asked if the Town has ever run out of water? Ben said once or twice the tanks have run out. Back in 2022 when it was a very dry year the tanks went dry once. Jared Rawlinson arrived at 8:12. Berry Anderson felt if the Town were to annex, that could help the water situation as the Town charges impact fees which could help buy water. DeAnn wondered if the Town has enough water to supply the lots already owned in Town if so, there should probably be enough to supply those currently in the process of annexing enough water now as not all of the inside lots will be wanting to develop at the same time. Some might not want to develop for years. With all due respect, Kirt felt that the water problems happened about 10 or 20 years ago and he doesn't want to kick it down the road now. He wants to get it handled. Dave has an issue that he is trying to annex now so his daughter can build now. He can't hardly wait for five years for a Town Well upgrade. Kirt pointed out that Dave and DeAnn aren't the only ones wanting to annex. There are others that have already discussed it with the Town and Andersons have already applied for annexation. Allysa wondered if the Town needed a new Well in place before any annexation is done? Courtney felt that anyone already in the annexation process should be able to annex. Jared felt the Town could go ahead with the current annexations and only allow one or two lots per annexation until the water situation was taken care of. DeAnn stated that if they need to put in a road and a water line, they need to sell at least one or two lots just to pay for that. Kirt said the Town Attorney said that the Town can't put an indefinite moratorium on inside-of-town water connections. Dale asked what lot size was being considered for the annexations. The Mayor stated they would be 1 Acre lots. Shawn thought that if someone annexed, they had to donate water shares to the Town. That is not so, they have to pay an impact fee which can be used to purchase water if desired. DeAnn pointed out that it is very difficult for an individual to buy one or two water shares to donate to the Town. It is much easier for the Town to purchase water shares as needed. The impact fee could go towards water purchase. A few water shares being donated to the Town won't really solve the Town's problem anyway. The main problem is the source. Probably need to get with an engineer and go over things. The Mayor mentioned that there is a grant that might be available to the Town or maybe a loan. DeAnn might be able to help the Town apply for this. Kirt felt like there are two annexations in the process, Steele's and Anderson. He would like to go ahead with these two annexations and put a moratorium on any other annexations until the water issue is figured out. Nick asked if there are very many roadblocks on the acquisition of a new Well. Not really, just money. Dale suggested making sure not to place a new Well in an area where the Town wants to grow as there will be source protection issues. E. Discuss and Possibly Accept for Further Consideration the Annexation Petition Submitted by Dale Pratt. Dale will need to present his Annexation Petition to the Planning and Zoning Commission but he was given time to show his Petition to the Town Council at this time. He presented a Map showing where his property is located and what he wants to annex. The Mayor brought up a Map on the computer and went through it with Dale, the Council, and those present. There will be 5.79 acres. Dale presented a Plat Map and a survey description and showed how they hope to eventually divide the property. Went through where the road and utilities would go. Dave pointed out that Rocky Mountain is serving properties there so if this is annexed, the Town would probably have to work with Rocky Mountain to see how the power would be served. Dale is okay with holding off until the water situation is worked out. F. Public Comment. Dave recommended that the Council Members and the Treasurer and Clerks look through the book: 'Powers and Duties Handbook for Utah Municipal Officials'. It has some very good information in it. G. Monthly Financial Report. The Financial Report was Read and Approved by Board Action. Kirt told Alyssa to not print out copies of the Report for everyone as he felt it was a waste of paper and he was able to present the Report on his computer. However, if the Council Members want individual copies, it can be done. H. Departmental Reports. Copeland. Getting new curtains for the Town Hall. Shawn Gonder. Outages: 12/31 Outage reported by Scott Fuller. Approximate time 11:00 a.m. Dixie Power called to investigate and discovered a blown fuse on the 260 East underground extension. They determined no line fault and restored power at 1:50 p.m. 3 customers affected. Operations and Actions: 1. Dixie Power Installed permanent service to Nathan Henderson shed on 12/22. 2. Dixie Power installed pole, transformer, and permanent service to Melissa Finlinson Home. Also relocated service for the Blair Cropper home from the new transformer. 12/23. 3. Phone call with Barry Deardon of Rage Development about service requirements for T-Mobile site on TV Hill. Sent a Utility Service Application to him. 4. On the November 2025 Utah Associated Municipal Power Systems (UAMPS) billing, Oak City had net energy delivery of 251,345 KWH. Total cost/KWH was $0.07786. The total bill was $19,570.21. Purchase price was below required operating margin, so a Power Cost Adjustment was not ordered on The December billing. Meetings Attended by Dave Steele: 01/10 Met with Wid Richie of Vision Metering, Mayor Dutson, and Shawn Gonder to discuss status of the AMI Trial (Town Hall). Attended UAMPS Interim Pool Project Meeting (Zoom). Attended UAMPS January Project Committee Meetings. (Zoom). Attended UAMPS State Legislature Briefing (Zoom). This will be weekly during the State Legislature Session. Jared Rawlinson. Waiting to get stuff back on the road development. Hoping to get a grant but might have to get a loan. Ed Lovell has been putting in rock on the sides of some of the roads for a shoulder. Tom Nielson. Was not in attendance and had left no report. I. Miscellaneous. Barry wondered about Net Metering Solar Power but the Mayor was not interested in this at this point. The Mayor stated that he will be trying to keep future Town Board Meetings to an hour's length if possible. J. Adjourn.
