Central Valley Town, Utah RESOLUTION 2026-001 A RESOLUTION ADOPTING THE CENTRAL VALLEY TOWN CODE TITLE 15 CONSTRUCTION STANDARDS; PROVIDING FOR REPEALER, SEVERABILITY, AND AN EFFECTIVE DATE WHEREAS, §10-20-101 of Utah State Code (as amended) allows the Town to enact ordinances, resolutions, and rules and enter into other forms of land use controls and development agreements that the Town considers necessary or appropriate for the use and development of land within the Town, including ordinances, resolutions, rules, restrictive covenants, easements, and development agreements governing transportation and public or alternative transportation; infrastructure; street and building orientation; width requirements; or public facilities; and WHEREAS, Central Valley Town desires to adopt the Central Valley Town Construction Standards prepared by Jones and DeMille Engineering, Inc., in March of 2026, which adopts by reference the 2025 edition of the Manual of Standard Specifications published by the Utah Chapter of the American Public Works Association (APWA) with certain local amendments as described therein; and WHEREAS, Pursuant to the processes described in §10-20-205 and §10-20-212 of Utah State Code (as amended), the Planning Commission provided notice and held a duly noticed public hearing as required to consider any objections and to recommended approval of the proposed Central Valley Town Construction Standards to the Town Council for adoption; and WHEREAS, after holding a duly noticed public meeting, and upon making its necessary reviews, the Town Council found it to be in the best interest of the Town to adopt the Central Valley Town Construction Standards, which shall be supplemental to the Town's Code. NOW, THEREFORE, BE IT ORDAINED by the Town Council of Central Valley, Utah: SECTION 1: Repealer. If any provisions of the Town's Code previously adopted are inconsistent herewith they are hereby repealed. SECTION 2: Adoption. The Central Valley Town Construction Standards, attached as Exhibit 'A' are here by adopted. SECTION 3: Severability. If any section, subsection, sentence, clause, or phrase of this amendment is declared invalid or unconstitutional by a court of competent jurisdiction, said portion shall be severed and such declaration shall not affect the validity of the remainder of this amendment. SECTION 4: Effective Date.
