Cleveland Town Council Meeting Approved Minutes January 8, 2026 The regular meeting of the Cleveland Town council was held at the Public Safety Building located at 130 W Main in Cleveland, Utah, on Thursday, January 8, 2026 at 7:00 pm. In attendance were: Kristen Vose, Mayor Shawna Horrocks, Whitney Guymon, Carl Sitterud. Chance Thompson was absent. Clerk Nancy Livingston. Public Attendance: Rayne Jensen, Kerwin C. Jensen, Lisa Jensen Called to order at 7:11 pm. Pledge led by Mayor Horrocks. Minutes: Kristen Vose made a motion to approve December meeting minutes. Seconded by Whitney Guymon. All were in favor, motion passed. Public Comments/Questions: none Item #1 Swear in elected officials, mayor and 2 council. The Town Clerk, Nancy Livingston, swore in the newly elected officials of mayor, Shawna Horrocks, and 2 council members, Kristen Vose & Whitney Guymon. Item #2 Council members need to complete a Conflict of Interest form and training on OPMA (Open Public Meetings Act) by Jan 31, 2026. Clerk, Nancy Livingston, told council that they need their OPMA certification, conflict of interest, and ethics form into the office by January 31. Item #3 Discuss/Approve/Deny Forbidden Fruit rental lease for Katie Player. Shawna Horrocks made a motion to renew Forbidden Fruit contract with no changes for Katie Player. Second by Whitney Guymon. All in favor, motion passed. Item #4 Discuss/Approve/Deny adopt Wildland Urban Interface (WUI)Code in House Bill 48 into the Town's Ordinances. Explanation given by clerk, Nancy Livingston, that the state was requiring all municipalities to adopt this Code. Motion by Whitney Guymon with a second by Carl Sitterud. All in favor, motion passed. Item #5 Discuss/Approve/Deny Rayne Jensen would like to speak about the noncompliance issue located at 190 N 50 W, Cleveland. Rayne Jensen gave a timeline review of the property located at 190 N 50 W from the time they started buying in 2015 to now. Read papers from HUD about easements and warranties. New house put in 2016. Kerwin C. Jensen stated that in August 2018 complaint filed against them for manure on sidewalk. He put the sheds up in 2020 next to sidewalk. No one said anything to him when he was building his sheds. Fall of 2022 told sheds were illegal. Letter sent in 2023. Rayne Jensen feels that appeal vote was done illegally. Didn't receive correspondence for the denial until December. Attended town council meeting and brought up issues she felt were pertinent to the issue and nothing was done. She stated that the town didn't get an easement for the sidewalk so that is part of her property. Rayne Jensen said that UDOT was okay with them driving over their sidewalk in 2023. She said that when the town abated the street going West it caused a problem. And they were never informed about the subdivision being undivided. They said that they received a letter telling them to survey property. Rayne Jensen went to someone out of town because Wasey Allred wasn't available to do it. Surveyor said it didn't need to do it if it was done before. Found that pins were gone. She had someone survey it in 2023. Then Wasey Allred did come in Dec. 2025 and pinned property. Want Town Council to approve where sheds are because sidewalk should be included in the 5 feet of setback. Please let us get to the simplest solution, give us a variance for the property or we need to say okay how are we going to handle this. We need to be neighborly and stop the fines. Kerwin Jensen said it would cost an estimate of $15,000 to cut and move them. Kristen Vose made a motion to table item #5 till next month and revisit it then. Second by Carl Sitterud. All were in favor, motion passed. Item #6 Discuss/Approve/Deny Cemetery Policy Change. Changed vaults to include a PSB selection. Need to add liability when digging graves clause. Item #7 Discuss/Approve/Deny Set dates for Cleveland Days planning meetings, Easter Egg Hunt, HWY 155 cleanup, Tree Lighting Ceremony, Christmas Party. Easter Egg Hunt will be March 28. Cleveland Days planning Committee will be before council meetings the 2nd Thurs. of the month at 6 pm. Tree lighting will be Dec 3 with the Town Christmas party on Dec 18. No dates set for Highway clean up. Council would like nominations for Angel tree to refine list with other organizations so only the really needy families are on the list and not on other charity lists. Look at texting price for messaging about town activities. Item #8 Discuss/Approve/Deny letters for noncompliance and updates with ongoing compliance issues. Updates: Shed at 300 West not moved, have until Jan. 29 to move before start fining daily. Dog noncompliance fine was paid on Jan 3, 2026. Item #9 Discuss/Approve/Deny bills and city financials for payment. Motion to pay the bills and city financials was made by Whitney Guymon. Second by Kristen Vose. Roll Call Vote: Whitney Guymon-yes, Kristen Vose-yes, Mayor Horrocks-yes, Carl Sitterud-yes. All were in the affirmative, motion passed. Item #10: Council Reports. Chance Thompson: (LEPC): absent Shawna Horrocks: (CVSSD, EMS):nothing new. Kristen Vose(PZ): Attended the NCRS presentation by Lowell Gardner to residents that live along Sand Wash. Asked residents to write concerns or problems. NRCS has funding to help removal of brush removal. Need to look into what town can do to help clear wash. Looked up sewer ordinance that states residents are required to use sewer system. Had a question about the ordinances-shouldn't updates to ordinances have the same number with a letter. Want to make sure that we are doing ordinances correctly. Planning and Zoning approved zoning for Nick & Shianne Larsen to addon to the front of their house, and continued working on recreational vehicle court ordinance. Whitney Guymon (YC): Shirts getting done. Carl Sitterud (Rec): will be attending Rec board meeting next week. Item #11 Adjourn Meeting. Whitney Guymon made a motion to adjourn the meeting. Second by Shawna Horrocks. All were in favor, meeting adjourned. Nancy Livingston, Clerk
