Purpose of Public Notice
The Utah Department of Environmental Quality (DEQ) is soliciting comments on the request to modify a ground water discharge permit as described below. The ground water discharge permit is issued by the Director of the Division of Water Quality under authority of the Utah Water Quality Act, Section 19-5-106(g) Utah Code Ann. 1953, as amended and Utah Admin. Code R317-6. Under Section 19-1-301.5, effective May 8, 2012, a person who wishes to challenge a Permit Order may only raise an issue or argument during an adjudicatory proceeding that was raised during the public comment period and was supported with sufficient information or documentation to enable the Director to fully consider the substance and significance of the issue. Groundwater Discharge Permit No. UGW010016 is being modified for the continued operation of swine production facilities owned by Mango II-Milford, LLC ('Mango II'). Although previously operational, currently, the site is idle and no hogs are present at the farm sites located in Beaver and Millard Counties, approximately 10 miles north of Milford, UT. Under active operations, manure from the hog production facilities is washed into anaerobic basins for treatment and storage. The lagoon systems at each farm site consist of one primary storage basin and one containment basin for evaporation, or an anaerobic digester. In addition to well monitoring the basins are lined with a flexible membrane liner for the protection of ground water. The ground water quality beneath farm sites ranges from Class II Drinking Water Quality to Class III Limited Use Water Quality.
Modification to the Permit
At the request of the Permittee, changes were made to the Permit, including general language changes for consistency across all of Mango II's Ground Water Discharge Permits and changes to the out-of-compliance notification process. The changes proposed in this modification include:
1. Revisions to probable out-of-compliance and out-of-compliance notification requirements.
2. Adjustments to probable-out-of-compliance and out-of-compliance confirmation sampling frequencies.
3. Timeline adjustments for the submission and implementation of Source and Contamination Assessment Study Plans.
4. General language edits throughout the Permit to improve clarity and consistency with Mango II's other Ground Water Discharge Permits near Milford, Utah.
Public Comments
Public comments are invited any time prior to March 6, 2026. Written comments may be directed to the Division of Water Quality, PO Box 144870, Salt Lake City, UT 84114-4870. All comments received prior to close of business on March 6, 2026, will be considered in the formulation of final determinations to be imposed on the permit. A public hearing may be held if written requests are received within the first 15 days of this public comment period that demonstrate significant public interest, and substantive issues exist to warrant holding a hearing.
