RESOLUTION 2026-01-15 A RESOLUTION AUTHORIZING A MORATORIUM ON THE SALE OF CEMETERY PLOTS WITH SPECIFIC EXCEPTIONS WHEREAS, Mantua Town owns and operates Mantua Town Cemetery; and WHEREAS, the Mantua Town Cemetery has limited space; and WHEREAS, it is in the best interest of the town and its residents that there be a limit on the purchasing of plots until a time when the town can expand the current cemetery or acquire additional property where an additional cemetery can be placed; and WHEREAS, the Town Council finds that there is good cause for imposing a twelve (12) month moratorium on the sale of new cemetery plots, with certain exceptions, until a decision is made on the limit of purchasing lots; NOW, THEREFORE, be it hereby Resolved by the Town Council of the Town of Mantua, Utah, as follows: 1. No cemetery plots in the Mantua Cemetery will be sold to non-residents for the period of twelve (12) months following the adoption of this Resolution. 2. Residents of the Town of Mantua may purchase up to two (2) plots. 3. Definition of a Resident: Definition of a Resident: 1. Current Resident Status: o An individual must currently reside in the Town of Mantua. o The residency requirement is defined as having a permanent home in Mantua for at least six (6) consecutive months. o The individual must intend to remain in Mantua indefinitely. 2. Exceptions for Temporary Absence: o An individual who is attending school elsewhere is still considered a resident if their permanent address remains in Mantua and they intend to return after completing their education. o Individuals called on a mission for their church or other religious service are considered residents if their primary residence remains in Mantua and they plan to return upon completion of their duties. o Residents who move into a care facility elsewhere, such as a nursing home or assisted living, but maintain their permanent home in Mantua, continue to be recognized as residents if there is an intent to return. 4. Transfers of cemetery plots to non-residents shall be suspended for the twelve (12) month period. 5. Interment in the Mantua Town Cemetery shall continue to be allowed as normal in any plot where the ownership of the plot has been paid for and recorded prior to this Resolution. 6. The Town Council is directed to prepare updated policies regarding the limit of cemetery lot sales and approve and adopt those policies prior to the expiration of the moratorium period. 7. Any unusual circumstances that may create an exception to this moratorium will be addressed by the Mayor, Town Council, and Town Sexton. This Resolution No. 2026-01-15 providing a moratorium on cemetery plots shall take effect immediately upon publication as required by law.
