3. Discussion on who is responsible for evictions.
There was a lengthy discussion on this subject. It had been previously thought that P&Z was responsible for administrating this item. Chair Nate Noyes reported that he had been reading in the State manual, and that P&Z was to recommend the action to the Town Board, and the Town Board would be the body to issue a letter of eviction. It was also decided that P&Z would invite the individuals responsible for the infraction to the next P&Z meeting and explain why this was happening and the process that was to be followed. The secretary will contact Braden Munk and Richard Sanders and invite them to the next meeting.
4. Discussion on the scale placement at the Munk farm.
Again, there was a lengthy discussion on this subject as well. There is still a question about whether or not the scale is a 'structure'. We reviewed at letter from Town Attorney Seth Tait on this subject where he quoted Section 2.162 ,7.2.7, and 2.17 of the Code. If it is a 'structure', then it cannot be located in the 30-foot setback area. Sid Munk has informed Nate Noyes, if he can't have the scale there, he wants to locate it on East 5800 N. There are also some issues with this location as the legal position of the road is in question. This issue has been brought up before and never resolved.
The secretary will contact Town Attorney Seth Tait and set up an appointment to get more information on these items. P&Z members will be invited. A Monday or Friday morning appointment will be requested.
