November 10, 2025 DIVISION OF WATER QUALITY UTAH DEPARTMENT OF ENVIRONMENTAL QUALITY PUBLIC NOTICE TO ISSUE A SECTION 401 WATER QUATLITY CERTIFICATION PURPOSE OF PUBLIC NOTICE The purpose of this public notice is to declare the State of Utah's intention to issue a Section 401Water Quality Certification with Conditions under the authority of the Federal Clean Water Act (33U.S.C. ยง 1341), and consistent with the Utah Water Quality Act, Title 19, Chapter 5, Utah Code and Utah Administrative Code R317-15. PERMIT INFORMATION PERMITTEE NAME: Wright Development Group MAILING ADDRESS: 1178 W. Legacy Crossing Blvd, Suite 100 Centerville Utah 84014 PROJECT LOCATION: Centerville, Davis County, Utah PROJECT: Centerville West Project CERTIFICATION NO.: DWQ-2025-09001 WATERCOURSES: Palustrine emergent wetlands (PEM) and unnamed ditches in Davis County. BACKGROUND Wright Development Group (the Project Proponent) is proposing to construct an apartment complex, a fueling station, and a convenience store known as the Centerville West Project (Proposed Project) in Centerville, Davis County, Utah. The Proposed Project will be located on an 8.55-acre undeveloped parcel located north of Parrish Lane and west of 1250 West Street in Centerville between Interstate 15 and Legacy Parkway. The Proposed Project will include constructing amenities for the apartment complex, parking for the development, two stormwater detention basins, and infrastructure for the fueling station. The Project Proponent indicated that the Proposed Project was necessary to provide housing and fuel access to accommodate the area's growth. In 1996, this site was permitted by the U.S. Army Corps of Engineers, authorizing the discharge of fill material into 3.0 acres of WOTUS. The previously issued permit has expired, and ownership of the property's has changed. After the permit expired, 0.9 acres of WOTUS were filled without permit coverage. The Project Proponent is seeking an after-the-fact permit for the unauthorized fill and additionally proposes to fill approximately 1.34 acres of palustrine emergent wetlands (PEM) and 1,000 linear feet of an open-water ditch with 37,363 cubic yards of fill material. The Project Proponent indicated they will implement measures to protect aquatic resources outside of the project area. The proposed project will temporarily impact 0.01 acres of open water ditch. Compensatory mitigation will be fulfilled with the purchase of Machine Lake Bank credits. PUBLIC COMMENTS Public comments are invited any time prior to the deadline of the close of business on December 10, 2025. After considering public comments the Utah Division of Water Quality may execute the Section 401 Water Quality Certification issuance, revise it or abandon it.
