ORDINANCE NO. O-44-2025 AN ORDINANCE OF EAGLE MOUNTAIN CITY, UTAH, APPROVING THE SUMMITIG UTAH, LLC FRANCHISE AGREEMENT PREAMBLE WHEREAS. SummitlG Utah, LLC is a telecommunications fiber company seeking to install and operate its equipment within the public rights-of-way in Eagle Mountain City; and WHEREAS. the City has authority under state law to grant non-exclusive franchises for the use of its public rights-of-way for telecommunications and related services; and WHEREAS, Eagle Mountain City staff has negotiated the terms of a Franchise Agreement with SummitlG Utah, LLC to establish the conditions under which SummitlG Utah may install, operate, and maintain its infrastructure; and WHEREAS, the proposed Franchise Agreement outlines SummitlG Utah's responsibilities, including compliance with applicable laws, restoration of disturbed property, and payment of applicable fees; and WHEREAS, the City Council finds that entering into the Franchise Agreement with SummitlG Utah, LLC. as set forth in Exhibit A, is in the best interest of the City and its residents by supporting infrastructure expansion and telecom connectivity: NOW THEREFORE, BE IT ORDAINED by the City Council of Eagle Mountain City, Utah: 1. The City Council finds that all required notices and hearings have been completed as required by law to consider and approve the SummitlG Utah, LLC Franchise Agreement, as set forth in Exhibit A. The agreement is approved by this Ordinance. 2. This Ordinance shall take effect upon its first publication or posting. ADOPTED by the City Council of Eagle Mountain City, Utah, this 7th day of October, 2025.
