Notice of Intent to Create Mill Creek Cemetery District
In accordance with Utah Code §17D-1-210 and 17B-1-211, the Marriott-Slaterville City Council will be holding a Public Hearing on October 16, 2025, at 7:00 p.m., in the Marriott-Slaterville City Legislative Chambers located at 1570 West 400 North, Marriott-Slaterville, Utah, to take public comment in support and opposition creating the Mill Creek Cemetery District ('District'). The City Council adopted a Resolution giving its Notice of Intent to create the District to provide cemetery services in accordance with Utah Code §17D-1-201(18). A protest to the creation of this District may be filed within 60 days of the public hearing in accordance with Utah Code §17B-1-213. The text of the Resolution is summarized as follows:
The Legislative Body of Marriott-Slaterville City in accordance with Utah Code §17B-1-203(1)(e) hereby gives its Notice of Intent to create the Mill Creek Cemetery District as follows:
1. The City Council declares that the public health, convenience, and necessity require the creation of a special service district for a cemetery as there is limited cemetery space available and some residents have expressed a desires for such a service.
2. The City Council intents to create the Mill Creek Cemetery District as a special service district under state law.
3. The area proposed to be included in the Mill Creek Cemetery District shall include the municipal limits of Marriott-Slaterville City.
4. The proposed Mill Creek Cemetery District will be funded by a combination of user fees and ad valorem property taxes.
5. The Mill Creek Cemetery District shall operate cemetery maintenance and services authorized by Utah Code §17D-1-201(18) and as otherwise provided by State Law.
6. The Mill Creek Cemetery District shall operate in accordance with Title 17B, Limited Purpose Local Government Entities - Special Districts, Chapter 2a Provisions Applicable to Different Types of Special Districts, Part 1 Cemetery Maintenance District Act of the Utah Code Annotated.
