Amalga Planning and Zoning Minutes August 20, 2025 7:00 PM 6590 N 2400W Amalga, Utah This meeting was held due to cancelling the regular meeting scheduled for August 6 because a quorum was not available. Visitors: Dustin Bingham, Mayor Dave Wood, Jeff Broadbent, Dianna Broadbent Commission Members: Kelly Noble, April Hansen, LeAnn Campbell, Dave Lee/Secretary 1. Welcome new member LeAnn Campbell to P&Z. 2. Motion to Approve Minutes of June 4, 2025-Kelly Noble Second-April Hansen Motion Carried 3. Business License Applications from Dustin Bingham at 2720 W 8600 N for two businesses: DB Mechanics, and DB Earthworks. These are licenses only. The actual businesses are mobile, and not at his residence. The zone he lives in does not allow this type of business on the property. Motion to Approve-Kelly Noble Second-April Hanse Motion Carried 4. Discussion on the scale Sid Munk wants to place in the 30' setback area on the farm. P&Z reviewed the letter from the Town Attorney, Seth Tait, and it was determined that the scale is a structure(2.162) and therefore not allowed in the 30' setback area. Mr. Munk was unable to attend this meeting. 5. Discussion on the property that Kurtis Falslev purchased from the Jorgenson Trust. On May 3, 2025, Jared Wiser appeared before the Commission. Minutes from that meeting are as follows. ' A discussion was held with Jared Wiser, representing Kurtis Falslev about building on the Keith Jorgenson property located across the road from Jason Munk at approximately 2900 W 5700 N. There is about 61 acres involved. Mr. Falslev is interested in buying this property, which is currently up for sale, and building a single residence on it. The commission explained that town code requires a minimum of 1 acre and 150' of frontage. There is some issue here about the Cache Canal that runs along the edge of the property near the road. It was explained that any issues with the canal would have to be worked out with the canal company. The Planning and Zoning Commission has no legal interest in that part of the negotiation. The question was raised about the Amalga Towns Code that only allows one house to be built on a minor subdivision property, and then having to wait four years from the time the building permit is issued before another piece of property could be subdivided. Mr. Wiser also posed the question if after, as an example, the owner wanted to subdivide after two years and create a major subdivision, would that be allowed. The commission was uncertain as to an answer to this question. Mayor Wood said he would contact our attorney for an opinion. As mentioned above, this was a discussion only, no approvals were given, and no action taken.' A year before this, the Town had adopted a new Minor Subdivision policy to align us with State Code. This was also explained to Mr. Wiser. On January 3, 2024, Mike Jorgenson appeared before the Commission. Minutes from that meeting are as follows. 'Application from Mike Jorgenson for a subdivision of property. Property to be divided is along 5700 N at approximately 2900 W, Parcel Number 13-040-0005. After discussion with Mike, he decided to change how he wanted to divide this property. He will re-apply at a later date.' The process for a minor subdivision was explained. Mr. Jorgenson subdivided the property without following the process. P&Z was unaware of this until it was discovered that Mr. Falslev had purchased the property. He was contacted in November 2024 by Certified Mail to say that he was in possible violation of Amalga Town Code. He contacted Dave Lee, Secretary, by phone and requested to be put on the next agenda. He then decided that as he was not going to do anything with the property, he would wait until such time as he decided what he wanted to do. Mr. Lee explained to him that until the property was properly subdivided that no Zoning Clearances for any type of work or building would be approved. In June of 2025, the Town was notified that he was moving dirt and doing other work on the property. The bulk of his property is in the Wetlands Zone of Amalga Town. He was sent another Certified Letter that he was in violation of Town Code and needed to contact P&Z. He contacted Secretary Dave Lee by phone and was again told that he could not do any work on the property without first properly subdividing the property. He was placed on the agenda for August 6, 2025, which meeting had to be cancelled because a quorum was not available. He was unable to attend the P&Z meeting rescheduled for August 20, 2025. He will be contacted again to place him on the agenda for September 3, 2025. Planning and Zoning decided that the first step in this process is to meet with him. Secretary Dave Lee will contact him to make sure he is aware of the meeting. Mr. Lee will also try and contact Trevon Stephens of the Army Corp of Engineers to see if they have any interest in this situation. 6. The Planning and Zoning Commission needs two new members to be appointed. The Mayor said he had 2 or 3 people he was going to contact.
