ORDINANCE NO. O-35-2025 AN ORDINANCE OF EAGLE MOUNTAIN CITY, UTAH, ADOPTING THE EAGLE MOUNTAIN CITY FISCAL YEAR 2025-2026 ANNUAL BUDGET TOTALING $119,105,860 AND THE CERTIFIED TAX RATE PREAMBLE WHEREAS, the City Council of Eagle Mountain City finds that it is in the public interest to adopt an annual budget for operations, debt amortization, and capital outlay to define more accurately revenue projections, capital projects and to authorize necessary expenditures. BE IT ORDAINED by the City Council of Eagle Mountain City, Utah: 1. The City Council finds that all required notices have been given and that a public hearing has been conducted on June 3, 2025 and June 17, 2025, where public comment was received and considered, and that the Council may consider and adopt the Fiscal Year 2025-2026 budget. 2. 'BUDGET YEAR' means the 2025-2026 fiscal year for which this budget is made, unless the context of the Ordinance requires otherwise. 3. 'FISCAL YEAR' means that year which begins on the first day of July 2025 and ends on the last day of June 2026. 4. APPROPRIATIONS. The Municipal Budget (the 'Budget') for Eagle Mountain City for the fiscal year is hereby adopted as set forth on Exhibit A and incorporated as though fully set forth herein. From the effective date of this Ordinance, the several amounts stated in Exhibit A expenditures are appropriated for expenditures within each fund and department enumerated in the budget. 5. ANTICIPATED REVENUES. The stated anticipated revenues include revenue from all sources, including grants and loans, except such revenues as derived from Revenue Bonds and Special Improvement District Bonds funding, and shall be classified in accordance with the chart of accounts of the municipality. 6. FUND BALANCE. The fund balance for each fund shall be available for emergency appropriation by the City Council. 7. ANTICIPATED SURPLUS FROM MUNICIPAL UTILITY OR ENTERPRISE FUNDS. The anticipated revenue and proposed expenditures of each utility or other public service enterprise owned or operated by the City is stated in a separate section of the budget; and as to each such utility, anticipated surplus, if legally available for general purposes and to the extent such surplus is to be used to support budget operations, is stated as an item of revenue in the budget. 8. APPROVAL OF EXPENDITURES. The Mayor shall be the Budget Officer and have charge of the administration of the financial affairs of the City and to that end shall supervise and be responsible for the disbursement of all monies and have control over all expenditures to ensure that the appropriations to each department and fund are not exceeded. He shall exercise financial budgetary control over each office, department, and agency and shall cause separate accounts to be kept for the items of appropriation contained in the budget. 9. COMPLIANCE WITH STATE STATUTE. The Budget Officer is hereby directed to file a certified copy of the adopted budget with the Utah State Auditor's Office 30 days from adoption of this ordinance. This Ordinance shall be forwarded to the County Auditor and the State Tax Commission in accordance with UCA 59-2-913 and 59-2-920, and the Mayor is authorized to execute the Certified Tax Rate Resolution provided by the State Tax Commission with a rate of 0.000534%. 10. ADOPTION & EFFECTIVE DATE. This Ordinance adopting the budget of Eagle Mountain City for 2025-2026 is hereby adopted on June 17, 2025, and effective for the fiscal year 2025-2026. ENACTED this 17th day of June, 2025.
