PUBLIC NOTICE TO ISSUE A SECTION 401 WATER QUATLITY CERTIFICATION
PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare the State of Utah's intention to issue a Section 401Water Quality Certification with Conditions under the authority of the Federal Clean Water Act (33U.S.C. ยง 1341), and consistent with the Utah Water Quality Act, Title 19, Chapter 5, Utah Code and Utah Administrative Code R317-15.

BACKGROUND
Ogden City (the Project Proponent) is proposing to remove the existing navigation hazard just south of the recently completed Ogden Kayak Park and create a surf wave (Proposed Project) within the Weber River. The Proposed Project will include the installation of pneumatically operated gates and rubber rocks to control the hydraulics, a concrete access ramp, a surf wave, and a fish passage channel. The proposed project will be located on the Weber River at the abandoned concrete weir diversion site, just downstream (north) of the Ogden Kayak Park, located at Exchange Road in Ogden, Utah. The Proposed Project will be located entirely in the main channel of the Weber River and will include the placement of non-native fill materials, such as concrete, grout, steel, and rubber. The total project-related impacts to the river channel and banks are approximately 1.4 acres, with approximately 0.8 acres of impacts to Waters of the U.S. (WOTUS) resulting from the placement of approximately 2,277 cubic yards of fill material. The Proposed Project spans a total length of 440 linear feet along the riverbank. The Project Proponent indicated that the Proposed Project will improve the existing channel, remove the old concrete diversion structure that is creating a navigational hazard, while meeting the Project Proponent's goal of creating a whitewater recreation feature that also allows for fish passage.

Public comments are invited any time prior to the deadline of the close of business on September 2, 2025.
