NOTICE OF REGULAR MEETING OF THE CORNISH TOWN COUNCIL August 6th, 2025 at 7:00 PM _______________ Public Notice is hereby given that the Cornish Town Council will hold a regular meeting on Wednesday, August 6, 2025 starting at 7:00 PM, in the Cornish Town Hall: 4788 W 14300 N, Cornish, Utah. The meeting will also be available via Zoom. Please email your request for a link to the ZOOM Meeting to cornishtownhall@gmail.com and the link will be forwarded to you. You may also call the town clerk at 435-754-3067 to make arrangements to have the link information forwarded to you. Because of the need for proper public notice, immediate action will not be taken in the Council Meeting. If action is necessary, the item will be listed on a following agenda, however, the Council may elect to discuss the item if it is an immediate matter of concern. The Town Council may vote to go into executive session pursuant to Utah Code 52,4,5. The Public is invited to participate in all Town Council meetings. Mayor Leak called to order a regular Cornish Town Council meeting on July 2, 2025, at the Cornish Town Hall, located at 4788 W 14300 N Cornish, Utah 84308 at 7:08 p.m. Attendance: Mayor Matt Leak, Councilmember Buxton, Councilmember Colton Creech, Councilmember Forsgren, Lauren Draney, Town Clerk Absent: Councilmember Brad Fisher Citizens: Staff Report: Lauren reported that she had the list of delinquent accounts and that there were several that were due to be shut off. Mayor Leak asked if Lee had paid. Lauren said that he did. Mayor Leak said that he has a plan with Lee and so far Lee is sticking to it. Mayor Leak read off who the other shut offs were. They discussed where they live. Mayor Leak said that Kathy Elliott does not live in Cornish here and he texted her. Councilmember Buxton mentioned that the Solis' house is accumulating a lot of stuff including trailers. Councilmember Forsgren said that the Wrights are getting to be the same way. Mayor Leak said that everyone but Lee will get a shut off letter. Lauren also reported that she talked to Town Web, and they have deleted the domain so there is nothing they can do. Lauren said that she investigated the requirements for hiring and she couldn't find any set requirements. Minutes: Mayor Leak said that there was a correction that needed to be made on line 97. Barlow is charging people with a 'suggested donation' so if someone gets hurt, he is protected since it is a donation. Mayor Leak entertained a motion to approve the minutes for the regular council meeting on June 18, 2025. Councilmember Creech - Motioned; Councilmember Buxton - Seconded Councilmember Buxton - Aye; Councilmember Creech - Aye; Councilmember Fisher - Absent; Councilmember Forsgren - Aye; Mayor Leak - Aye The minutes were approved unanimously. Cornish Minute: Councilmember Buxton commented that the first automatic milking machine in town was in the 1920's not far from Mayor Leaks house. Councilmember Forsgren said that the house he tore down in front of his current house, inside the walls it said 1903. The house was moved from the alley. Bills: Total = $21,095.68 (Total does not include Horrocks invoice). Mayor Leak said that they are still going to hold off on the Horrocks invoices. Councilmember Buxton asked about putting the invoices for Valley View into the budget for $10,000 and the rest into the RAPZ). They reviewed the invoices from Valley View. Councilmember Creech pulled up a map and asked where everything was. Councilmember Buxton explained where everything was. Councilmember Creech asked if they took out the old tank. Councilmember Buxton said that they knocked the lid off and filled it with gravel. Councilmember Creech asked about the bill from BSC. Mayor Leak said that it was for a couple of leaks by Colleen's house. Mayor Leak entertained a motion to approve the bills minus the invoice from Horrocks. Councilmember Forsgren - Motioned; Councilmember Creech - Seconded Councilmember Buxton - Aye; Councilmember Creech - Aye; Councilmember Fisher - Absent; Councilmember Forsgren - Aye; Mayor Leak - Aye The bills passed unanimously. Action Items: Executive Session: Business Items: Easement - Councilmember Creech said that he would like to get an easement to get access to the pumps as well as power going across the Town's property. Mayor Leak said that it would be for repairs. Councilmember Creech asked if the Town would be willing to go through the process to get the easement. They talked about where to put access for the easement. Mayor Leak said that it would be better to do it along the property line, if possible, instead of through the property. Councilmember Forsgren asked if they need to do two easements, one for the power and another for ingress/egress. Councilmember Creech said that he did one for his house. Councilmember Forsgren said that it might not give you access from both sides of the property. Mayor Leak said that he doesn't care if they are driving across to get to the pump, but it would be better to get an easement for future things. Mayor Leak said to go ahead and move forward on it and bring it back to the council to vote on it. Roads- Councilmember Forsgren said that he is trying to get ahold of Jeremy but has not been successful. Mayor Leak said that he can call if he needs to do so. Councilmember Creech asked if Jeremy had come out to see what needs to be done. Councilmember Forsgren confirmed that he has and that they have a plan. Councilmember Buxton said that the street sign on the corner of 13400 North and 4800 West had been knocked over. He said that it just needs to be put back up. Planning & Zoning - Councilmember Creech said that they Heiner's did a subdivision. He said he talked to the County about not recording anything that is not approved by the land use authority. The County said that the recorder still is required to record anything that comes in. Councilmember Creech said that the county has a program called 'property watch' that lets you know when anything is recorded on your property. They also have a program called 'city watch' for anything recorded in your town. Councilmember Forsgren asked if the town is still required to maintain the road and Councilmember Creech said yes, it is still a public right of way. The city watch program is now set up for Cornish town and the city town clerk will be notified by email. Councilmember Creech said that he has been looking at the water connection fees for other towns and he thinks that it might be too low. He suggested going to $3,000 or $4,000. Mayor Leak said that they would have to justify raising the fee. He explained that they can look at the cost charged to the town and look at the impact that it has on the system. Mayor Leak said that when they had the water moratorium there were a few councilmembers that were not going to vote for it because a lot of people would want the water hookups and we wouldn't be able to keep up with the demand, along with a lot of requested subdivisions. Councilmember Buxton asked if some places do charge an impact fee. Mayor Leak explained that impact fees are to be used for the fees incurred within two years. He explained that it would cost more to do a project than the money you get for the impact fee. Councilmember Creech will do some research on the matter. Parks/Town Hall/Finance - Councilmember Buxton said that he is hoping that by the end of the month the parking lot should be done. Councilmember Creech asked about the line painting. Councilmember Buxton said that he has not figured that out yet. Councilmember Creech asked about the concrete for the shed. Councilmember Buxton said that there will be a pad to the curb back about 12 feet. We will have water and power hooked up to the shed. He explained that he thinks by the next RAPZ we will do the lights and the backstop. He thinks we will be able to do the fence in the budget next year on the south side. Councilmember Buxton said that Jay had caught the cable to the flagpole with the mower and it bent over. Councilmember Buxton said that every community has a population allocation, and the town has about $3,000 that he was thinking of using to replace the flagpole. Mayor Leak said that the town should get a big flag. Water - Councilmember Fisher was not present. Councilmember Buxton asked if the well was doing ok. Mayor Leak said that so far it is good. Old Business: Mayor's Report: Mayor Leak asked if Doug Maughan was being charged for two garbage cans. Doug doesn't know where the other can is. The town will provide another can and charge Doug Maughan for a new one. Mayor Leak said that he was called about a dog issue this week. He said that the County does not provide animal control for Cornish. Max Pierce is the animal control person for Cornish. Mayor Leak said that there were a couple of dogs that got loose and killed chickens and caused damage to a car. Mayor Leak said that because the town does their own animal control, they need to decide what to do with the dogs. Councilmember Creech said that there was evidence on a home camera showing what happened. He also said that the dogs had damaged another person's property as well. Mayor Leak said that he needs to follow up with the officer to let him know what they decided to do with the dogs. Mayor Leak said that Max from Horrocks and Kyle Loveland reached out about treatment plans. They asked about tests from the springs. He said that he doesn't think that they have tests specifically from the springs other than nitrates. Councilmember Buxton asked if the big test they recently did would work. Mayor Leak did not think that the Town has them. He asked the council if they should pull samples on the springs to see where they are at. Councilmember Forsgren said that it sounded reasonable to do the test. Mayor Leak suggested that they have specific things they need to test for and to do tests on each spring rather than combined. Councilmember Buxton asked if we need to check for bacteria or just the simple test. He asked how soon they should be pulled. Mayor Leak said that he will let Max know that they will do the tests but ask them specifically what they need. Mayor Leak said that they are past the 30-day deadline with the State and have not responded. He asked the council how they felt about responding and telling the State that because they have not responded the Town will move forward with their project as if the springs were not under direct influence. Councilmember Creech asked how solid the 30-day wording was. Mayor Leak read the email and it was a definite 30 days. Councilmember Forsgren said asked what would happen if he did that. Mayor Leak said that it would likely only make them mad. Councilmember Creech said that he felt the response would be fair but that we should spend a lot of time on how we say it, how we respond. We should tell them that we didn't hear from you, and we've informed our engineers that we are good to go. Mayor Leak played a part of a voicemail from Sunrise about the Cache Water District about getting information about the water system. He sent an email to everyone that details the information that they are looking for. Mayor Leak suggested that Cache Water District come out here and we can tell them what we have.
