(Rough Draft) Minutes of Oak City Town Planning and Zoning Meeting Held July 16, 2025 The meeting was held at the Oak City Town Hall located at 30 West Center beginning at 7:20 p.m., as a quorum was not present until then, in the Conference Room. The following attended: Town Officials Others Interim Chairman Dylan Finlinson Nick Bauman Member Kendall Dewsnup-Absent Elissa Bauman Member Mason Anderson Dave Steele Member Peggy Kooyman DeAnn Steele Member Colin-Absent Jess Peterson, R6 Mayor Shim Callister Kurt Dutson (attended by phone call) The following Agenda items were considered: A. Invocation. The invocation was given by Dylan. B. Adopt Agenda. Dylan moved, seconded by Peggy, to adopt the Agenda as written. Roll Call Vote: Dylan-Aye. Kendall-Absent. Colin-Absent. Peggy-Aye. Mason-Aye. C. Adopt Minutes of the Planning and Zoning Commission Meeting held Wednesday, June 18, 2025. Dylan moved, seconded by Mason, to adopt the Minutes as written. Roll Call Vote: Dylan-Aye. Kendall-Absent. Colin-Absent. Peggy-Aye. Mason-Aye. D. Discuss Building Permit Application for Approximately 330 N Main-Nick Bauman. Dylan presented a copy of the Application to each Commission Member. The Property is annexed into the Town. The home would be located about center of the property. The concern that Mason had was the fact that there are two ditches on the property and if they have head gates installed there, it is level and would possibly cause flooding. Nick wondered if he could have the head gates removed as they don't need the water from the ditch. There will be some extra dirt, might be able to use that to make a berm or another dirt ditch that would collect it so the water doesn't flood his property. Kurt Dutson, who attended the meeting remotely, made a suggestion that might handle the flood water situation. Nikki talked to Tom Nielson who said that he would like to get bids for the water parts and go from there. The Mayor called the Town attorney and asked about the road. He said it wouldn't affect anything now but will need to be looked at in the future. If anyone built behind Nikki, they would have to build their part of the road. Nikki wondered where the road easement would go in near 300 North, would he and the Dutson's be able to negotiate sharing the responsibility of the easement? (Rough Draft) They are looking at underground water and power lines. There would be a bridge over the ditch. Dylan wondered how the Proposal fits into the town's codes? The Mayor said it fits the codes fine. Dylan moved, seconded by Mason, to recommend the Town Council approve the Buanams' building permit application with the contingency that the flood plain will be worked out with the ditches. Roll Call Vote: Peggy-Aye. Kendall-Absent. Mason-Aye. Dylan-Aye. Colin-Absent. E. Discuss Zone Change at Approximately 215 E 200 N-Dave and DeAnn Steele. Dave showed the Commission the area they are looking at on the map. The Town boundary goes through their back yard. They did annex it but the maps don't show such an annexation. It is zoned R-2 meaning one acre lots. What they are mainly interested in dividing a lot into two lots but a road would have to go there so this would force the lots to be either .75 or .5 acre lots. There is a water line that needs a water right in that area too which would make it hard to split into acre lots. They don't have maps drawn up or plans but they would like to look at what the possibilities are. In the future, they would like to have lots for each of their children but that would need to be done by annexation and all of their children might not even want a building lot. The Mayor stated that he didn't see a real problem with it. Dylan suggested going with .5. The Mayor thought .4 would be okay. Mason mentioned that there is a one-inch water line in this area that his property is connected to. Will have to keep this in mind. The Steeles stated that they did not expect any action from the Commission tonight. They just wanted to pass the request by the Planning and Zoning Commission. The Commission thought the Steeles could go ahead with their plans knowing that there would be no problem with the plan to rezone. F. Discuss Updating the Town of Oak City General Plan-Shim Callister. Jess stated that he really didn't have a presentation. He mainly would like to the Town to come up with a specific plan and R 6 would write it up. Would like something specific written about the Park and some pictures. The Planning and Zoning own the General Plan. After it is developed, it is turned over to the Town Council. Jess stated that most of the surveys showed that residents don't want large businesses and very little growth. If the annexation policy is old, will want to update it and have an annexation map. Make sure subdivision ordinances are updated. Make sure to address that the Town doesn't want to grow. Need to be preventative as far as setting things up now to handle future problems or issues. The Planning and Zoning Commission basically calls the shots on the General Plan. Norman Olson mentioned that Mona has had a lot of impact from businesses coming in around the Town. Mona didn't want to grow but the County has allowed the growth. DeAnn stated that Oak Meadows is the same situation. It might be better to annex properties in so the Town has associated revenue and taxes rather than properties not being annexed but using the Towns facilities, and effecting the MAGi but not taxed by the town. Jess will send the Commission copies of other communities' general plans and annexation ordinances. The Mayor had sent some general plan notes to the Commission members but they hadn't had time to look at this in detail yet. (Rough Draft) At this point, the Mayor wondered what the Town should do, keep texting Jess back and forth with questions and changes? Dylan suggested each looking at the current new Plan and make changes, additions, and mark them up then go over this at a meeting. Jess can get the changes in and make copies. Jess will send a sample copy of an annexation policy. Dylan's suggestion was look at annexation first and then make notes on the general plan. G. Miscellaneous. There were no miscellaneous items. H.
