Minutes of Regular Town Board Meeting Held May 15, 2025 The meeting was held at the Oak City Town Hall beginning at 7:30 p.m. in the Conference Room. The following were in attendance: TOWN OFFICIALS Mayor Shim Callister Council Member Dave Steele Council Member Tom Nielson Council Member Copeland Anderson Council Member Jared Rawlinson Town Clerk Karen K. Lovell Town Recorder Angie Dewsnup OTHERS Tom and Nancy Oveson Traci Callister The following agenda items were considered: A. Invocation. The invocation was given by Shim. B. Adopt Agenda. Copeland moved, seconded by Dave, to adopt the Agenda as written. Roll Call Voted: Mayor Callister-Aye. Dave-Aye. Tom-Aye. Jared-Aye. Copeland-Aye. C. Adopt Minutes of Oak City Town Board Regular Meeting held Thursday, April 17, 2025. Dave moved, second by Copeland, to adopt the Minutes as written. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Copeland-Aye. Tom-Aye. Jared-Aye. D. Discuss Property Owners' Concerns About Property Boundaries Located at Approx. 230 N. 100 W. Shim stated that he had gone over the boundary issues with the Ovesons before. Ovesons said they knew the Town had deeded back some feet on the property. Therefore; Kimberly Oveson felt she had the right to put flowers on the property in front of her yard. She knew the property belonged to the Town but she thought she could still beautify it by putting in flowers. However; Ed Lovell came and sprayed the area, which had no flowers, and she wondered what he had sprayed with? Would it still allow flowers to grow? Instead of contacting the Mayor with the question, Kimberly had posted her concerns on social media. The Mayor responded to her there. The Ovesons have issues as they feel there are differences in the fence lines and the property lines that need to be addressed. Traci Callister stated that she had researched this issue with Millard County and found that the Town deeded property back to the landowners, in the area, all along the South side of the Street. Ovesons were also upset with the lane at the Lynn Banks property. Lynn claims it is a private lane but in order to be so, the Ovesons understood the lane needed to close one day a year to qualify as a private lane. As far as they know, this has never happened. Ovesons also felt that Ed Lovell should not be spraying if he is not licensed to spray. It should be done by a certified sprayer. The Mayor pointed out that the weed killer Ed sprayed is not a ground sterilant, and Ed has been spraying for the Town for many years as part of his preparation for mowing on the side of the street and knows what he is doing. Tom Oveson disagreed however; as he feels that the spray that has been used in the past, has destroyed his apricot trees. Shim offered to buy them new trees if they so desire. They declined the offer. To help the situation, Ed went to the Ovesons and apologized to them for the situation and brought them some flowers and planted them in the flower bed he had sprayed If there are any issues in the future, it was decided the best approach to the situation would have been for Kimberly to call the Mayor and talk to him personally and this would allow the Mayor to respond to her individually. E. Discuss Increasing Cemetery Fees and Updating the Cemetery Section of the Oak City Town Code. Tom had called Fillmore City offices and found that Fillmore charges parties that live in Town $350 and those outside are charged $700.00. The Mayor found the bylaws on the internet for the Delta-Sutherland-Oasis Cemetery District and they charge $500 for plots purchased by parties inside Millard County and $1,500.00 for those outside of the County. Oak City Town charges $400 for an 84649 zip code and $800.00 for outside that zip code. What can be done about someone living in town buying plots for family members that don't live in town? This is hard to police. Might have to assign a name to a plot. People not living in town are not paying money into the cemetery account or taxes. It was pointed out that families like to buy plots for the entire family even when they don't know for sure each family member will be buried in Oak City Town. Karen and Shim both stated that they have done this. The Mayor pointed out that whatever is done, it will be hard to police. Tom will do a little more research on this including talking to Jeff Lyman Oak City Town Cemetery Sexton. This will be placed on the Agenda for discussion at the June Town Board Meeting. On the subject of the Cemetery, Tom Oveson asked if the Town might consider putting in a bathroom at the Cemetery. The Mayor explained that there wouldn't be much room for a septic tank and leach line. This was discussed and some alternate options were discussed. Jared suggested looking into a toilet with a vault similar to some in the Canyon. The Mayor will look into this. F. Discuss and Set an August Date for a Public Hearing for Property Valuation and Tax Changes. Angie explained that this has to be considered on a separate date, from the Town Board Meeting, and be done in August at least 10 days after the County sets up its rates and then have to be able to do a public hearing and have it adopted by September. The State needs to know by June first the date, time, and place of the meeting. The Council considered this and will go with August 14th at 7:00 p.m. for this Public Hearing. G. Discuss 2024-2025 and 2025-2026 Budgets. Angie went over the two budgets quickly. She passed out copies to the Town Council Members. There are a few projects that will need to be done before the end of this fiscal year. Went over these and the extra that needs to be budgeted for each. She asked each council person for what they need before the end of the year and what to look at for next year. Will have a public hearing on August 14th at 7:00 p.m. for the budget. H. Closed Session-Town of Oak City Recorder Applicants. Jared motioned, seconded by Dave, to go into the Closed Session. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Tom-Aye. Jared-Aye. Copeland-Aye. The Closed Session began at 9:02 p.m. and was held in the Mayor's Office at the Town Hall. The Mayor reported that there were three parties that had applied. They were discussed. The Mayor adjourned the Closed Session at 9:17 p.m. The Regular Town Board Meeting continued at 9:18 p.m. As per the discussion at the Closed Session, the Mayor will make up a list of interview questions for the recorder candidates. He will get a copy of these questions to the Town Council for their input. The Mayor will then interview the candidates. I. Public Comments. Traci Callister would like to see a yield sign put in at the intersection that turns toward the Chappell home on Lovers Lane. It is a dangerous intersection. Jared will look into this. Possibly could put in a 4 way stop sign. Traci reported that the Veteran's Memorial is in. The benches are coming. J. Monthly Financial Report. The Financial Report was Read and Approved by Board Action. Angie went over the financial report quickly. There are quite a few delinquent accounts. The Mayor is working with a couple of the account owners. K. Departmental Reports. Jared Rawlinson. Precision Concrete came and looked at some of the problem sidewalks throughout Town. They will be submitting a bid. Looked at two spots with problem culverts. Did some digging and looked around. The Irrigation Company is in charge of the maintenance of ditches. Jared stated that State regulations say that the Irrigation Company is in charge of culverts. Jared will talk to the Irrigation Company and look at costs. The Mayor received an email from someone concerned about the speed of traffic coming down the Canyon. Jared will look into a solar speed sign. The County might help with the cost as it is a County Road. Copeland Anderson. The chairs arrived. Bought 210 chairs. Decided to sell the old chairs for $10.00 a-piece. Looking at shingling the Town Hall before next budget year. Got a bid of about $35,000 to do the shingles. The State passed a law, House Bill 48, that says that anyone that has built in high-risk fire area will need to pay a fee every year. Towns will have two years to get the 2006 Wildland Urban-Interface Code passed. It will have to be adopted and enforced by the Town. Tom Nielson. Ben Nielson, Oak City Town Public Works Specialist, and Tom got the backflow device in at the Bell Tower for the sprinkling system. Tom has had a few citizens contact him on the new backflow regulations. One of the biggest concerns is that it forces the backflow to come out of the ground, which could cause issues with freezing. Been watching the water levels and things look pretty good for the Town water wise. Should be a good summer water wise. Will be good to get the aquifer recharge in, however. The summer helper has been very good. She is a hard worker and always willing to help with whatever is needed. Dave Steele. Outages: 05-01-25 System outage sometime between 7:00 p.m. and 7:45 p.m. No apparent cause. At 9:35 p.m. a second System event occurred. Again, no apparent cause. Protection targets at the substation indicated Ground Fault on the distribution side (within town) for both outages. Operations and Actions: 1. 04-25 Opened Cutout-fuse for Curtis Jones service to allow him to upgrade his service panel. Re-closed after approval from building inspector. 2. Tree trimming completed from street light service conductors along Main Street and from primary conductors at various locations around town. 3. 05-03-25 Pete Jacobsen reports his well above town has no power. Blown fuse was replaced. This outage may be related to at least one of the May 01 outage events. 4. Treasurer reports the meter at Kendall Dewsnup is reading incorrectly. Dixie Power investigated but isn't sure of the problem, since it seems to be working again. Will watch to make sure it functions correctly or replace if needed. 5. 05-08-25 Dixie Power installed street light at entrance to Jon Finlinson subdivision. Also replaced pole damaged by fire last month on distribution line to Chance Adams. 6. 05-12-25 Dixie Power installed underground service to Crandall Nielson's pedestal on Cascade Spring Road. Also installed underground service conductor to Dylan Finlinson's new house, but did not energize, pending inspection. 7. On the March 2025 Utah Associated Municipal Power System (UAMPS) billing, Oak City had a net energy delivery of 287,794 KWH. Total Cost/KWH was $0.08290. The bill was $23,857.54. Purchase price was above required operating margin, so a Power Cost Adjustment of $0.01290 was ordered for the April billing. Meetings Attended: 04/30 Rocky Mountain Power 2025 Utah Wildfire Webinar (TEAMS Meeting). 05/01 UAMPS Budget to Actual Spreadsheet Discussion (TEAMS Meeting). Dave is going to be recommending a power rate increase before long. Should look at this by the first part of the new budget year. L. Miscellaneous. There were no miscellaneous items. M. Adjournment.
