Amalga Planning and Zoning Minutes June 4, 2025 7:00 PM 6590 N 2400 W Amalga, Utah Visitors: Ty Baily, Rusty Burnside, Rayslyn Larsen, Caleb Christensen, Mayor Dave Wood 1. Motion to approve minutes of May 7, 2025: Mike Diehl Second: April Hansen Motion Carried 2. Rusty Burnside wanted to know if he could put an arch in as part of the fence he is building for his home. The arch would not be on the property line but inset off the road. It would be high enough for semi's, horse trailers, and fire trucks to access the property. It was determined after he showed us what he wanted to do that this would be fine. No vote was taken, as there was no Zoning Clearance to be issued. 3. Application for a Zoning Clearance for a deck from Ty Baily at 2330 W Hwy 218. Ty is replacing his deck on the back of his house. He is doubling the length from 10 X 12 to 20 X 12. There were no clearance issues. Zoning Clearance was issued, and a fee was paid. It was later brought up by member Mike Diehl that perhaps a Zoning Clearance was not needed, as the new deck did not alter the original reason for the deck. In the past these types of situations have been required to get a Building Permit from the county. You normally have to have a Zoning Clearance to get one. Judy is going to contact the county to see what they say. If a Clearance is not required, the fee will be refunded. Motion to Approve: Judy Downs Second: Mike Diehl Motion Carried 4. There were three Code Amendments that were reviewed at a Public Hearing May 7, 2025. These need to be forwarded on to the Town Board as either recommended or not recommended. a. The first to be considered is the new Enforcement and Penalties Code that was received from Town Attorney Seth Tait to replace our outdated Chapter 6. It was agreed that this needs to be approved and moved on to the Town Board. A copy of this ordinance is available on the town website under Proposed Ordinances. Motion to Recommend Acceptance of this to the Town Board: Judy Downs Second: Mike Diehl Motion Carried b. The second to be considered is the Amendment to 3.16, Accessory Apartments within Residential Dwellings submitted by Howard Kunz. There was a lot of discussion on this issue. Positive points mentioned: Condensed housing allows better use of the home lots that are already here. It would protect farm land from being used up for homes. How about a certain area of town being rezoned for this type of building? Doesn't affect my open space. The city could recoup some money from new homes and possibly impact fees. Some people need that rental income. It would have to have a county building permit. Needs to be thought through very carefully. Impact fees could be positive for the town. Recommended a two-acre minimum. Why would we say 'no' when we don't know what the unintended consequences would be? Negative points mentioned: Public commenting has generally been against this amendment. It would create 2 homes on 1 lot. If allowed they should have to have separate water meters. Septic could be a problem, depending on how many people would be using a single septic tank, and soil make up. Parking might be an issue depending on how many drivers live in the ADU. The idea of building it expressly for a handicapped child or for another family member is not a good idea. This would in all likelihood not be low-cost housing. One step from a single home to a duplex. Maybe some of the buildings that might be renovated for this may not be all that nice. Impact fee could be negative. Separate utilities would increase the cost of the building. Too quick to look at only the negative of this request. Fire suppression could be an issue if the ADU was behind the main home. Other points: Bear River Health would be a big consideration. They would determine whether one septic tank would be acceptable, or whether they must have a separate septic system for the ADU. Motion to forward this code amendment to 3.16 of the Amalga Land Management and Development Code as not recommended: April Hansen Second: Judy Downs April Hansen is against it. Judy Downs is against it and would like to see the proposal amended before passing it on for recommendation. Mike Diehl is in Favor as it is currently written. Motion Carried 2-1 c. The third to be considered is the Amendment to 8.1 Mobile Home Use submitted by Sid Munk. Positive points mentioned: Affects only a very small, specific area-farms. Very specific as to who can live in them i.e. full-time, bonafide, farm workers. Doesn't affect anyone else. Eliminates a possible mobile home. Negative points mentioned: Conditional use permit to be renewed every four years. Item 2 needs to be clarified. Motion to forward this code amendment to 8.1 of the Amalga Land Management and Development Code as recommended with the following changes: To Item 2. To provide a temporary residence for a Bonafide farm worker, and their immediate family, i.e., parents, children, brothers, or sisters.
