NOTICE OF PUBLIC HEARING AND BONDS TO BE ISSUED NOTICE IS HEREBY GIVEN pursuant to the provisions of the Local Government Bonding Act, Title 11, Chapter 14, Utah Code Annotated 1953, as amended, that on July 10, 2014, the District Board (the ?Board?) of Magna Water District, Utah (the ?Issuer?) adopted a resolution (the ?Resolution?) in which it authorized the issuance of the Issuer?s General Obligation Bonds, Series 2014 (to be issued in one or more series and from time to time, with any other title or series designation directed by the Terms Certificate) (with such other series or title designation as determined by the Issuer) (the ?Series 2014 Bonds?) and to call a public hearing to receive input from the public with respect to (a) the issuance of the Series 2014 Bonds and (b) any potential economic impact that the improvements financed with the proceeds of the Series 2014 Bonds (see below) may have on the private sector. TIME, PLACE AND LOCATION OF PUBLIC HEARING The Issuer shall hold a public hearing on August 7, 2014, at the hour of 3:00 p.m. at the District?s Office located at 8600 West 2711 South, Magna, Utah. The purpose of the hearing is to receive input from the public with respect to (a) the issuance of the Series 2014 Bonds and (b) any potential economic impact that the improvements financed with the proceeds of the Series 2014 Bonds may have on the private sector. All members of the public are invited to attend and participate. PURPOSE FOR ISSUING THE BONDS Pursuant to the Resolution, the Bonds are to be issued for the purpose of (i) financing acquisition and construction of water system improvements, including water treatment facilities and related improvements and (ii) paying related expenses. PARAMETERS OF THE BONDS The Issuer intends to issue the Bonds in the aggregate principal amount of not to exceed Two Million One Hundred Fifty Thousand Dollars ($2,150,000), to mature in not more than four (4) years from their date or dates, to be sold at a price not less than ninety-eight percent (98%) of the total principal amount thereof, bearing interest at a rate or rates not to exceed two and one half percent (2.5%) per annum. The Bonds may be issued in one or more series, and be sold at such time, all as the Issuer may determine. The Bonds are to be issued and sold by the Issuer pursuant to the Resolution, with such final terms and provisions as may be deemed appropriate by authorized officers of the Issuer, provided that said final terms shall not exceed the maximums set forth above. A copy of the Resolution is on file in the office of the District Clerk of Magna Water District, Utah in the District offices located at 8600 West 2711 South, Magna, Utah where they may be examined during regular business hours of the District Clerk from 8:00 a.m. to 5:00 p.m. for a period of at least thirty (30) days from and after the date of publication of this notice. SECURITY PLEDGED FOR THE BONDS The Bonds are general obligations of the Issuer secured by the full faith and credit and taxing power of the Issuer. NOTICE IS FURTHER GIVEN that a period of thirty (30) days from and after the date of the publication of this notice is provided by law during which any person in interest shall have the right to contest the legality of the Resolution or the Bonds, or any provision made for the security and payment of the Bonds, and that after such time, no one shall have any cause of action to contest the regularity, formality or legality thereof for any cause whatsoever. The anchor location for this meeting where the public may attend and monitor the proceedings shall be the District?s board room at 2711 South 8600 West, Magna, Utah, unless otherwise specified above. Any Trustee wishing to participate electronically must notify the District Manager or the District Clerk personally prior to the meeting and provide the telephone number at which the Trustee can be reached at the appointed time. A conference call shall be initiated from the anchor location to each Trustee participating by telephone at the appointed time. If a Trustee is having difficulty connecting to the meeting, please call the District offices at 801-250-2118. This same procedure shall be used at any continuation of this meeting, unless otherwise specified in the meeting.
