MONA CITY COUNCIL MEETING JANUARY 28, 2020 COUNCIL CHAMBERS THE MEETING WAS CALLED TO ORDER BY MAYOR WILLIAM MILLS AT 7:30 P.M. PRESENT: William M. Mills - Mayor Randy Christensen Councilmember Jay Mecham Councilmember Frank Riding Councilmember Amy Stanley - Councilmember Micheal Stringer - Councilmember GUEST: Mike Hansen, Rural Community Consultants, Ryan Robinson Rural Community Consultants, ALSO PRESENT: Myrna Trautvein Times News Reporter Michelle Dalton-Secretary/Treasurer Everd Squire -Director of Finance, Lyla Spencer -City Recorder, Sarah Samuelson P&Z Secretary, Melinda Matheson Recreation Director OPENING PRAYER: Councilmember Amy Stanley APPROVAL OF JANUARY 14, 2020 MINUTES: Councilmember Micheal Stringer moved to make a motion to accept the minutes of January 14, 2020 as written. Councilmember Randy Christensen made a second to that motion. The vote was unanimous, motion carried. (1st Motion) ANNUAL OPEN MEETINGS TRAINING: City Recorder Lyla Spencer presented the annual 2020 Open Meetings Training for the staff. Spencer asked the council,Why are we here? The presiding officer of the public body shall ensure that the members of the public body are provided with annual training on the requirements of [the Open and Public Meetings Act] Utah Code Section 52-4-104. The Purpose is to conduct the people's business with transparency. Actions must be taken openly. Deliberations must be conducted openly. Who must comply? Any administrative, advisory, executive, or legislative body of the state or its political subdivisions that.Is vested with the authority to make decisions regarding the public's business. Examples, City Council, Appeal Authority, Planning and Zoning. MONA CITY COUNCIL MEETING JANUARY 28, 2020 OPEN MEETINGS: All Meetings must be open to the public unless specifically allowed to be closed under the act. What is a meeting? The convening of a public body, with a quorum present, whether the meeting is held in person or by means of electronic communications, for the purpose of discussing, receiving comments from the public about, or acting upon a matter over which the public body has jurisdiction or advisory power. Regular meetings, special meetings, workshops, executive session, site visits, traveling tours. Open Meetings do not include a chance meeting, a social meeting, and convening solely for discussion or implementation of administrative or operational matters if: no formal action is taken or the matters would not come before the body for discussion or action. Electronic Meetings: A public meeting convened or conducted by means of a conference using electronic communications. A public body may not hold an electronic meeting unless it has adopted specific procedures for conducting it. These may include considerations of budget, logistics, and presence of a quorum at an anchor location; vote to establish an electronic meeting, notice requirement, etc. Nothing restricts a member of a public body from transmitting an electronic message to other members of the public body at a time when the body is not convened in an open meeting. Utah Code Ann. 52-4-207 Closed Meetings: For what purpose? A closed meeting may only be held: To discuss the character, professional competence, or physical or mental health of an individual. Strategy sessions for: collective bargaining, pending or reasonable imminent litigation, purchase, exchange, or lease of real property or water rights/shares, sale of real property or water rights/shares, to discuss the deployment of security personnel, devices, or systems , to investigate proceedings regarding allegations of criminal conduct. May NOT do the following in a closed meeting: Approve any ordinance, resolution, rule, regulation, contract or appointment, interview a person to fill an elected position, take final action (final votes must be open and on the record). How do we close a meeting? The body must first hold a public meeting with proper notice, a Quorum must be present, 2/3 vote of the body must vote to close the meeting, the body must publicly disclose: The vote by name of each member for or against entering into the closed meeting, the reasons for holding the closed meeting, and location of the closed meeting. The information discussed in executive sessions is confidential and may not be discussed outside of the meeting, including with: members of the public, spouses, family members or significant others or the local newspaper as an anonymous source. The Public Body must give notice not less than 24 hours notice of each meeting, must also give notice of annual meetings scheduled in advance over the course of a year. Public notices must include the following: Agenda for the meeting, date, time and place for the meeting. Public notice shall be satisfied by: posting written notice at the principal office or the building where the meeting will be held; and on the Utah Public Notice Website. Providing notice to: At least one newspaper of general circulation within the geographic jurisdiction of the public body; or a local medial correspondent. MONA CITY COUNCIL MEETING JANUARY 28, 2020 Agenda: The public notice must provide reasonable specificity to notify the public as to the topics to be considered at the meeting. A topic raised by the public may be discussed during an open meeting, even if not included on the agenda, however, except for emergency meetings; the public body may not take final action on a topic not listed on the agenda. Emergency Meetings: Regular notice requirements may be disregarded if: Because of unforeseen circumstances it is necessary to hold an emergency meeting to consider matters of an emergency or urgent nature. Still required to give the best notice practicable. May not hold an emergency meeting unless: an attempt has been made to notify all the members of the public body; and a majority of the members approve the meeting. Public Hearing: The public notice for a public hearing must additionally follow any notice requirements specified in the statute requiring the public hearing. Meeting Minutes and Recordings for Open Meetings: The public body must keep written minutes and a recording. Written minutes must include; the date, time and place of the meeting, the name of members present and absent, the substance of all matters proposed, discussed, or decided by the body which may include a summary of comments made by members of the public body, a record, by individual member, of each vote taken by the public body, the name of each person who is not a member of the public body who provided invited testimony or comments to the public body, the substance, in brief, of the testimony or comments provided above any other information that any member requests be entered in the minutes. A recording of an open meeting shall be a complete and unedited record of all open portions of the meeting from the commencement of the meeting through adjournment. Meeting Minutes for Closed Meetings: The Public Body must make a recording of the closed meeting, except for meetings to discuss an individual's character or to discuss security in these cases the presiding officer shall sign a sworn statement affirming that these are the sole purposes for the meeting. The public body may keep detailed written minutes that disclose the content of the meeting. The recording and any minutes shall include: The date, time, and place of the meeting; the names of members present and absent; and the names of all others present except where confidentiality is needed to preserve the purpose of the closed meeting. Penalties: Any member of a public body who intentionally violate the closed meeting provisions is guilty of a class B misdemeanor. A court can avoid any action taken in violation of the open meetings law; the public body may have to pay court costs and attorneys fees if successfully challenged in court on a violation. REMEMBER: that you represent the people of Mona City and should at all times act with dignity and respect, discussions and debates among council members should always remain civil and professional, it is not appropriate for council members to attempt to influence criminal investigations or prosecutions. PLANNING AND ZONING: MONA CITY COUNCIL MEETING JANUARY 28, 2020 DELEGATIONS: Mike Hansen and Ryan Robinson from Rural Community Consultants (RCC) presented a proposal for Zoning Ordinance and Plan Update to the council including a Work Order proposal: Mona City Ordinance Revisions, along with Planning Initiative Scoping Issues, Mona City General Plan Initiative, 2019-2020 and Mona Citys General Plan plus Code compliance evaluation as of January 2020. Attached to the minutes is information presented by Rural Community Consultants (RRC) which will become a permanent part of the minutes for public viewing. DIRECTOR OF FINANCES, SECRETARY/TREASURER & RECORDERS REPORT: Director of Finance Everd Squire presented The Mona City Disbursement Listing for checking dated 01/15/2020 to 01/28/2020. There were no questions on the financial report. There were four (4) checks over the allotted amount of $2,000. The Disbursement Listing is attached and will become a permanent part of the minutes for public viewing. Also presented was Mona Citys Operational Budget Report which includes 10 General -07/01/2019 to 01/27/2020 with 58.33% of the fiscal year expired. Mona Citys Operational Budget Report 51 Water 07/01/2019 to 01/27/2020 with 58.33% of the fiscal year expired. Mona City's Operational Budget Report 52 Sewer 07/01/2019 to 01/27/2020 with 58.33% of the fiscal year expired, in conclusion Mona City's Operational Budget Report 55 Natural Gas 07/01/2019 to 01/27/2020 with 58.33 % of the fiscal year expired. COUNCIL BUSINESS: There were no business licenses or fence permits presented. Mayor Mills presented Mona City's Fee Schedule for the year 2020. Changes for the schedule will be for the Community Center Rental for Non-Residents only. Mayor Mills will call a work session in the near future to go over other possible fee increases. The Mayor asked for a motion to approve the Non-Resident rental fees for the Community Center as follows: $100.00 two hour plus $100 refundable cleaning deposit, $150.00 Non Resident six hours plus $100 refundable cleaning deposit, $300.00 Non-Resident full day Plus $100 refundable cleaning deposit, $150.00 Non-profit that requires a cost to attend plus $100 refundable cleaning deposit. $450 Non-Resident a day before and full day of event plus $100 refundable cleaning deposit. Councilmember Randy Christensen moved to make a motion to approve Mona City's Community Centers Non-Residents fee as described above with a second by Councilmember Amy Stanley. Motion Carried. (2nd Motion). Councilmember Amy Stanley is currently working on the 24th of July Celebration for 2020. MONA CITY COUNCIL MEETING JANUARY 28, 2020 Council member Micheal Stringer told the council the scout is coming Saturday to help him. Councilmember Stringer would like the city to purchase a Chevrolet Silverado 1 ton flat bed. Councilmember Jay Mecham asked Times News Reporter Myrna Trautvein to write an apology for him in regard to a word he used at the last council meeting, which he felt was inappropriate. Melinda Matheson Mona Recreation; things are moving along, tumbling will begin the first week in February. Mayor Mills ended the council session by reminding the council about the ULCT Conference April 22-24 in St George. FYI: There were three (3) motions voted upon and passed, a motion to approve the January 14, 2020 minutes, a motion to approve a fee increase for the Community Center Non-Resident, and a motion to adjourn this meeting of January 28, 2020. All motions are recorded and in the cities records. PAY FINANCES ADJOURNMENT: Councilmember Frank Riding moved to make a motion to pay the finances and adjourn, Councilmember Micheal Stringer made a second to that motion, all were in favor, motion carried. (3rd Motion) The city council meeting was then adjourned at 9:01 p.m., with no further comments.
