AN ORDINANCE OF NORTH OGDEN CITY AMENDING THE ZONING ORDINANCE OF NORTH OGDEN CITY TITLE 11, CHAPTER 22, SECTION 7: SIGNS PERMITTED FOR NONRESIDENTIAL USES IN SPECIFIC DISTRICTS, REVISING SUBSECTION (C)(2)(c) DRIVE-IN RESTAURANTS
WHEREAS; The current City ordinance relating to drive-through menu signs has been determined to be inadequate for present-day needs; and
WHEREAS; This amendment updates in a reasonable manner the standards relating to drive-through menu signs to be more compatible with customer needs and current industry standards; and
WHEREAS; Updating these standards will allow signs for drive through menus to be more comparable with other locations of drive-through restaurants elsewhere;
NOW THEREFORE, BE IT ORDAINED by the North Ogden City Council that the North Ogden City Code 11-22-7 (C)(2)(c) be amended to revise the standards for menu signs.

11-22-7 (C)(2)(c) Drive-Through and Drive-In Restaurant Menu Signs
(1) In addition to the signs allowed in subsections C1 and C2 of this section, drive-through and drive-in restaurants may have two (2) freestanding menu board signs located at least thirty feet (30') from the front and street side property line which conform to the following standards:
(A) Number of signs:
(a) Menu Signs: Each commercial site shall be allowed a maximum of two (2) menu signs. If two (2) ordering lanes are used, one (1) per lane is allowed. Two (2) menu signs may be used in the same lane, if only one (1) ordering lane is used.
(b) Pre-sale Signs: One (1) additional sign, with a maximum square footage of twelve (12) square feet, that is used to illustrate, describe, and promote selected product offerings to customers on site, known as a pre-sale sign, shall be allowed.
(B) Height: Seven and one-half feet (7.5') is the maximum permitted height for menu signs. The maximum permitted height for pre-sale signs is six feet (6').
(C) Area: Forty five (45) square feet is the maximum permitted area per sign.
(D) Awnings and Accessory Items: Awnings are allowed, but must be approved as part of a building permit. The colors used for the awning must be consistent with the color scheme used on the building. Up to one (1) separate microphone stand is allowed per menu board sign.
(E) Location: In addition to the above-listed thirty foot (30') distance requirement from a public right-of-way, menu signs, pre-sale signs, and accessory items must be fifty feet (50') from a residential zone. Distance requirements shall apply to all accessory items related to menu signs, in addition to the menu signs themselves.
(F) If located on the side of the building facing a public right-of-way, menu signs shall not be located between the access lane used for ordering and the public right-of-way; the sign must be between the access lane used for ordering and the building, or elsewhere.
(G) Orientation: Signs shall be oriented a minimum of 30 degrees away from parallel to Washington Boulevard when located between a building and Washington Boulevard, or closer to the public right-of-way than the building face closest to Washington Boulevard.
(H) Digital menu signs are permitted.
(2) Each parking stall covered with a canopy may have one freestanding sign located to the side of the parking stall if the sign conforms to the following standards:
(A) Each sign area shall not exceed fifteen (15) square feet.
(B) Maximum height shall not exceed five feet (5') in height as measured from the parking lot pavement surface directly below the sign.
(C) Maximum width shall not exceed three feet (3').
(D) Such signs shall be located on the side of the parking stall, but no closer than three feet (3') from the end of the parking stall.
(E) No restaurant shall have more than fifty (50) of the above described freestanding signs located to the side of parking stalls on the site.
SECTION 2: This ordinance shall take effect upon adoption.
