Ogden City City Council May 24, 2016 City Council Chambers Municipal Building - Third Floor 2549 Washington Boulevard, Ogden, Utah 84401 3:30 p.m. Joint Work Session City Council, Redevelopment Agency and Municipal Building Authority City Council Work Room The purpose of the joint work session includes presentations and discussions regarding: Redevelopment Agency: - Agenda review for Special Redevelopment Agency meeting; - FY2017 Proposed Budget; and - Board Business. Municipal Building Authority: - FY2017 Proposed Budget; and - Board Business. City Council: - Agenda review for City Council meeting; - Gibson Community Plan - Gibson Plan Rezone - M-2 to M-1 for the area generally located west of the railroad tracks - Gibson Plan Rezone - M-1 to R-1-5 for the area generally south of 17th Street fronting on Gibson Avenue and Center Street - Gibson Plan Rezone - M-1 to C-3 for the area generally west of Wall Avenue between 15th and the Ogden River - Gibson Plan Rezone - M-1, M-2 and CBD to O-1 for the area generally adjacent to the Ogden River and the 21st Street Pond - Proposed amendment to the C-3 zone eliminating the Truck Terminals use; - Refugee Resettlement; and - Council Business. Any items not fully addressed prior to the City Council meeting, which begins at 6:00 p.m., may be addressed immediately following that meeting. 6:00 p.m. City Council Meeting Council Chambers 1. Roll Call. 2. Pledge of Allegiance. 3. Moment of Silence. 4. Public Hearings: a. Proposed Removal of the Stout Home from the Local Historic Register. Proposed Ordinance 2016-28 rescinding the prior designation for the Allen Joseph Stout home as a local historic resource on property located at 885 12th Street. (Adopt/not adopt ordinance - roll call vote) 5. Reports from the Planning Commission: a. Petition to Amend Maximum Height Limits in the M-1 and DDR Zones. Proposed Ordinance 2016-29 amending section 15-22-1 of the Municipal Code to increase the maximum height requirements in M-1 and DDR zones. (Receive public input; adopt/not adopt ordinance - roll call vote) 6. Public Comments. This is an opportunity to address the Council regarding concerns or ideas on any topic. To be considerate of everyone at this meeting, public comments will be limited to three minutes per person. Participants are to state their name and address for the record. Comments which cannot be made within these limits should be submitted in writing to the City Council Office (citycouncil@ogdencity.com). The Council encourages civil discourse for everyone who participates in our meetings. Comments pertaining to an agenda item that includes a public hearing or public input should be given during the meeting as that item is discussed. 7. Comments: a. Mayor. b. Council Members. 8. Adjournment. Special Redevelopment Agency Meeting Council Chambers 1. Roll Call. 2. Public Hearing - Oak Den Urban Renewal Project Area: a. Presentation: 1. General information concerning the proposed Oak Den Urban Renewal Project Area, and the procedures, requirements and reasons for creating the Project Area. - Melven Smith, Assistant City Attorney, Tom Christopulos, Director, Community and Economic Development and Jonathan Springmeyer, Bonneville Research, Consultant to the Agency. 2. Presentation of summary statement, including purposes of the blight hearing and proposed use of eminent domain; receipt of written objections of owners of property within the proposed project area, if any. - Melven Smith, Tom Christopulos. b. Motion to open Public Hearing and Blight Hearing (voice vote): c. Blight Hearing and presentation of evidence of existence or nonexistence of blight within the proposed Oak Den Urban Renewal Project Area: 1. Presentation of blight study and of evidence in support of a finding of blight within the proposed Urban Renewal Project Area. - Jonathan Springmeyer 2. Examination and cross-examination of witnesses providing evidence of blight, by record owners of property located within the proposed Urban Renewal Project Area or by the record property owner representatives. 3. Presentation by record owners of property located within the proposed Urban Renewal Project Area or by the record property owner representatives, of evidence and testimony, including expert testimony, concerning the existence or nonexistence of blight. 4. Presentations by other interested persons or their representatives, including expert testimony, concerning the existence or nonexistence of blight. 5. Public input regarding the proposed Oak Den Urban Renewal Project Area, and presentation of oral objections of owners of property within the proposed Project Area, if any. d. Motion to close Public Hearing and Blight Hearing on Proposed Oak Den Urban Renewal Project Area. (voice vote) e. Agency Board question and deliberation period and consideration by Agency Board of all objections received, the issue of blight, and of the evidence and information relating to the existence or nonexistence of blight. f. Consideration of proposed Resolution 2016-10 making a finding regarding the existence of blight in the proposed Oak Den Urban Renewal Project Area. (Adopt/not adopt resolution - roll call vote) g. Consideration of proposed Resolution 2016-13 selecting the Oak Den Urban Renewal Project Area in the Oak Den Survey Area and authorizing the preparation of a draft project area plan, including a draft project area budget, pursuant to section 17C-2-102(1)(b), Utah Code Annotated 1953, as amended. (Adopt/not adopt resolution - roll call vote) h. If needed, consideration of whether to continue the hearing and blight hearing to a future date, time and place certain. (Continue/not continue hearing - voice vote) i. If needed, public announcement of the date, time and place hearing will be resumed. 3. Public Comments. This is an opportunity to address the Board regarding concerns or ideas on any topic. To be considerate of everyone at this meeting, public comments will be limited to three minutes per person.
