NOTICE OF BOARD OF EQUALIZATION AND REVIEW HEARING OGDEN CITY CENTRAL BUSINESS DISTRICT SPECIAL ASSESSMENT AREA NO. 3 Economic promotion and revitalization of Ogden's downtown business district is a priority for the Ogden City Council and Administration. Ogden City enjoys numerous quality downtown events, programs, activities, and promotions each year. Multiple fund sources, including the City's general fund, are being drawn upon in order to accomplish these important objectives. It is proposed that a portion of the cost of these downtown promotion activities be paid by a special assessment to be levied against commercial properties located within the assessment area ('CBAA 3') that are directly or indirectly benefited by the downtown promotion activities. The total budget of these major downtown promotion activities, including, but not limited to, the Ogden Farmers Market, amphitheater events, Twilight Series, Pioneer Days downtown events, Ogden City Arts program, Jupiter Train, Christmas Village and other economic promotion activities, is estimated to be $684,000. The proposed assessment levy would fund up to $161,000 (23%) of the total estimated budget with the remainder being funded by Ogden City (77%) out of general funds and other approved sources. The assessments are levied against the properties that may be directly or indirectly benefited by such economic promotion activities, which benefits need not actually increase the fair market value of the properties to be assessed. In no event will Ogden City assess more than the total annual aggregate amount of $161,000 against the properties benefitted within the assessment area. The levy within the CBAA 3 is placed upon commercial properties only. Residential (4 units or less), tax-exempt, and commercial properties with levy amounts of $30.00 or less per year are exempt. The portion of the total proposed assessment levied against a property which is identified as a parcel number, is expected to be paid annually for a three-year period beginning in 2016 and continuing through and including 2018. The amount of the assessment against a property is based on the sum of two separate assessment methods. The first assessment method is based on the taxable value of a property as stated on the Weber County tax rolls. The second assessment method is based on the location of a property in relation to the enhanced activity area, which is the center of the majority of the activities described above. Owners of property within the CBAA 3 will pay the assessment as a line item amount in the annual property tax notice received from Weber County. Payment, due by November 30 of each year of the CBAA 3, shall be paid to the Weber County Treasurer's Office, which will make a distribution of collected amounts to Ogden City. The Assessment becomes a lien against the property and remains until the Assessment is paid. A Board of Equalization and Review, comprised of members of the City Council, will conduct public hearings on three successive days; May 31, 2016, June 1, 2016, and June 2, 2016 between the hours of 4:00 p.m. and 5:00 p.m. in the City Council Chambers, Municipal Bldg. - Third Floor, 2549 Washington Blvd., Ogden, Utah to consider objections and to make corrections of any proposed assessments which the Board may find to be unequal or unjust. This notice is to inform property owners of the amount of the proposed Assessment and the time and place of the Board of Equalization and Review hearings.
