13. Receive Public Comment on the Community Development Block Grant (CDBG) Final Statement of Projected Uses of Funds ? 2013-2014
RECOMMENDATION: The Community & Neighborhood Services Manager recommends the City Council hold the first of two public hearings to receive public comment on the projected uses of funds for the 2013-2014 Community Development Block Grant.

BACKGROUND: During the past few months, the CDBG Citizen Advisory Commission heard funding proposals from various applicants who wish to receive CDBG funding. The Commission presented its recommendations to the City Council in a work session on March 19, 2013. The City Council is now ready to receive public comment on the proposed uses of funds.
Following a second public hearing that is scheduled for April 30, 2013, at 6:00 p.m., the City Council will adopt a resolution approving the CDBG Final Statement of Projected Uses of Funds for 2013-2014.

14. ORDINANCE - Amending Appendix A of the Orem City Code by Allowing Standard Land Use Code 6835 Dancing Schools as a Permitted Use in the M2 Zone
REQUEST: Paul Washburn requests the City allow Standard Land Use Code 6835 Dancing Schools as a ?permitted? use in the M2 zone.

BACKGROUND: The applicant requests the City Council allow Dance Schools in the M2 zone. Dance schools are currently permitted in the C2, C3, HS, and BP zones. Other uses allowed in the M2 zone that are similar in nature include:
? 6233 Massage Therapy
? 6592 Educational & Scientific Research
? 7426 Health Spas
? 7425 Gymnasium and Athletic Clubs
Advantages:
? Provides additional options for those looking to locate a dance school in the city.
? Dance schools are compatible with other uses permitted in the M2 zone.
Disadvantages:
? None determined
Based on a positive recommendation from the Planning Commission and the advantages of this amendment, staff recommends the City Council approve this request.

15. RESOLUTION - Appointing Two Additional Judges to be Considered as Alternate Municipal Justice Court Judges When the Sitting Judge Cannot Hear a Case
RECOMMENDATION: The Director of Administrative Services requests the City Council, by resolution, approve Douglas Nielsen and Darwin Poulsen as additional alternate judges to the Orem municipal justice court

BACKGROUND: From time-to-time a sitting judge cannot hear cases either due to the judge being absent from the court for illness or other matter or the judge has a conflict of interest and is disqualified from hearing a particular case. State law provides for a list of approved alternates to be called upon as needed. The City had previously approved as alternates Rick Romney, Provo municipal justice court, Sherlynn W. Fenstermaker, Springville City municipal justice court, and Scott J. Cullimore, Utah County justice court.
The current list of alternate judges is comprised of full-time judges, it is wise to have some alternates who do not sit in a full-time justice court to substitute in Orem's full-time court to provide for the efficient flow of court business as needed.
All judges presently listed on the alternate list or recommended for the alternate list are approved by the State of Utah office of the Courts. Judge Nielsen is the sitting judge for the Lehi municipal justice court and Judge Poulsen is the sitting judge for the Highland/Alpine municipal justice court.
