New legislation was passed in the 2004, 2005 and 2006 legislative sessions that altered the Utah Mechanics' Lien Code. The new legislation outlined new requirements, options and processes for filing Notices of Commence, Preliminary Notices and Notices of Completion. The legislative changes were implemented in an effort to help property owners and project participants protect their investments in construction projects.
The initial changes to the Mechanic's Lien Code were contained in House Bill 136, which was passed in 2004. This bill called for the development of the SCR system and outlined the foundation of the new notification process and requirements. House Bill 136 can be read in its entirety by clicking here.
